Comment Date: September 5, 2000 Reply Date: September 20, 2000 This Public Notice seeks comment on a July 13, 2000 request by the American Trucking Associations, Inc., (ATA) and the American Mobile Telecommunications Association, Inc. (AMTA) to transfer ATA's frequency advisory committee certification to AMTA. Frequency coordination is the process by which a private organization recommends to the Commission the most appropriate frequencies for applicants in designated radio services. With limited exceptions, frequency coordination is required before the Commission will grant a license to an applicant in the Private Land Mobile Radio (PLMR) Services. In 1986, the Commission certified a frequency coordinator for each of the PLMR services. ATA was certified to provide frequency coordination services for the Motor Carrier Radio Service. In 1997, the Commission consolidated the PLMR services into two pools and authorized the coordinators of the services consolidated into the Industrial/Business Pool (including the Motor Carrier Radio Service) to coordinate all of the frequencies in the Industrial/Business Pool, with certain exceptions not relevant here. ATA and AMTA contend that, given the consolidation of the PLMR services, the Commission should no longer require a coordinator to represent a specific class of eligible users. Instead, according to ATA and AMTA, the key issues relating to certification transfer should be 1) whether the transferee represents eligible users, 2) whether the transferee has the requisite technical expertise, and 3) whether the transfer will enhance competition among coordinators. They assert that the proposed transfer meets these requirements, because 1) AMTA is a trade organization representing PLMR eligibles; 2) AMTA proposes to perform frequency coordination through an experienced engineering firm, using advanced software and personnel experienced in the coordination process; and 3) transfer of ATA's certification will provide another high-quality choice for PLMR eligibles seeking coordination services. In addition, ATA and AMTA argue that, while the Commission has never transferred a frequency advisory committee certification, the power to do so is within the Wireless Telecommunications Bureau's delegated authority.
