WASHINGTON, D.C. 20554 DA 99-1450 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Released: July 23, 1999 WIRELESS TELECOMMUNICATIONS BUREAU ANNOUNCES IT CONDITIONALLY GRANTS LEAP WIRELESS INTERNATIONAL 36 C BLOCK BROADBAND PCS LICENSES Auction Event No. 22 Report No. CWD-22-D (Auction No. 22) On April 15, 1999, the FCC completed its auction of 347 C, E, and F block broadband personal communications services (PCS) licenses. After a preliminary review of the FCC long- form applications (FCC Forms 601 and 602), applications for 302 licenses were accepted for filing. On July 22, 1999, the Wireless Telecommunications Bureau (Bureau) released a Memorandum Opinion and Order conditionally granting Leap Wireless International, Inc.'s (Leap) long form application. As stated in the Leap Order, one of the conditions of the grant is the full and timely payment of the remaining balance of its winning bids. Such payment must be received by the Commission within ten (10) business days of the date of this Public Notice (i.e., by August 6, 1999). See 47 C.F.R.  1.2109(a). If Leap fails to pay the balance of its winning bids in a lump sum by the applicable deadline as specified by the Commission, it may pay the remaining balance within ten (10) business days after the payment deadline (i.e., by August 20, 1999), provided that it also pays a late fee equal to five percent of the amount due. See 47 C.F.R.  1.2109(a). If Leap fails to pay the balance of its winning bid by the late payment deadline of August 20, 1999, it will be considered in default and subject to the applicable default payments. See 47 C.F.R.  1.2109(a). Such default will result in the assessment of default penalties as proscribed by sections 1.2104(g) and 1.2109(c) of the Commission's rules. See 47 C.F.R.  1.2104(g), 1.2109(c). Payment Instructions All payments must be made in U.S. currency in the form of a wire transfer. See 47 C.F.R.  1.2107(b). No personal checks, cashier's checks or other forms of payment will be accepted. Wire transfer payments must be received Mellon Bank by 6:00 p.m. Eastern Time, on August 6, 1999 (or 6:00 p.m. Eastern Time, August 20, 1999, along with the five percent late fee). Leap should allow sufficient time for the wire transfer to be initiated and for the transmission to be completed prior to the deadline. On the same business day that the applicant pays the balance due to Mellon Bank, the applicant must fax a completed FCC Form 159 to Mellon Bank at (412) 236-5702 at least one hour prior to placing the order for the wire transfer. On the FCC Form 159, applicants must use the same FCC Taxpayer Identification Number (TIN) used on their FCC Form 601s. When completing FCC Form 159, applicants must specify each license as a separate item. Applicants must type license number(s) in Block(s) 24A, 24B, 24C, and 24D ("FCC Code 2") of FCC Form 159. They must also type the auction number, "22," in Block(s) 23A, 23B, 23C, and 23D ("FCC Code 1"). As just noted, Form 159 provides sufficient boxes to list only four licenses. Applicants with five or more licenses must then use FCC Form 159-C ("Continuation Sheet") for the remainder of their licenses. License numbers should be identified by typing either "PB" (C block) or "CW" (E and F blocks) followed by the market designator (e.g., B189) followed by the frequency block (Blocks C, E or F), and the submarket, if applicable. An example of a correct license number would be: "PBB214E." The market designator, submarkets, and frequency block designations are listed in Attachment A.
