("PageNet") for Waiver of the Coverage Requirements for 900 MHz SMR Licensees Proceeding Classified As Permit-But-Disclose for Ex Parte Purpose On February 24, 1999, Paging Network, Inc. (PageNet) filed a request for waiver of the Commission's coverage requirements for its Major Trading Area (MTA) licenses in the 896-901/935- 940 MHz band. See Public Notice, DA 99-780, released April 22, 1999 (establishing pleading cycle). PageNet, which acquired its MTA licenses at auction, is seeking to obtain additional time in which to construct its Specialized Mobile radio (SMR) systems. On June 10, 1999, PageNet filed a request for that this proceeding be classified as permit-but-disclose for ex parte purposes. Requests for waiver of the Commission's rules are subject, unless otherwise provided, to treatment by the Commission as restricted proceedings for ex parte purposes under section 1.1208 of the Commission's rules, 47 C.F.R.  1.1208. Because of the policy implications and potential impact of this proceeding on persons not parties to the waiver request, we believe it would be in the public interest to treat this case as a permit-but-disclose proceeding under the ex parte rules. See sections 1.1200(a) and 1.1206 of the Commission's rules, 47 C.F.R.  1.1200(a) and 1.1206. Therefore, any ex parte presentations that are made with respect to the issues involved in PageNet's waiver request subsequent to the release of this Public Notice will be permissible, but must be disclosed in accordance with the requirements of section 1.1206(b) of the Commission's rules, 47 C.F.R.  1.1206(b).
