CWD 96-14 Comment Date: November 6, 1998 Reply Comment Date: November 23, 1998 On July 11, 1997, Western PCS II License Corporation (Western) filed a request for waiver of section 20.6 of the Commission's rules, 47 C.F.R.  20.6. Western seeks a permanent waiver of the 45 MHz spectrum cap codified in section 20.6 because its holds the Block B broadband Personal Communications Service (PCS) license for the Denver Major Trading Area (MTA) and various cellular markets within the Denver MTA. On September 8, 1998, Western filed an amendment to its Request for Waiver to add Colorado Rural Service Area (RSA) 4 to the list of its cellular holdings in the Denver MTA. According to Western those cellular markets include 13.6 to 16.9 percent of the Denver MTA population, exceeding the 10 percent "significant overlap" threshold set forth in section 20.6. Western seeks a permanent waiver of section 20.6 so that Western not be required to divest itself of the cellular operations causing it to exceed the 10 percent significant overlap threshold in section 20.6 Interested parties may file comments on Western's Request for Waiver on or before November 6, 1998. Parties interested in submitting reply comments must do so on or before November 23, 1998.
