Washington, D.C. 20554 DA 98-1477 Released July 23, 1998 WIRELESS TELECOMMUNICATIONS BUREAU CLARIFIES DATE OF PUBLIC NOTICE OF PCIA FORBEARANCE ORDER AND NOTICE OF PROPOSED RULEMAKING On July 2, 1998, the Commission released In the Matter of Personal Communications Industry Association's (PCIA) Broadband Personal Communications Services Alliance's Petition for Forbearance For Broadband Personal Communications Services, Memorandum Opinion and Order and Notice of Proposed Rulemaking, FCC 98-134. In that Order, the Commission granted in part and denied in part PCIA's petition to forbear from applying to broadband personal communications services providers several provisions of the Communications Act and the Commission's rules. The Commission also made conforming rule changes and sought comment on further forbearance in the Notice of Proposed Rulemaking (NPRM) portion of the item. PCIA has asked the Commission, in an ex parte letter dated July 17, 1998, to clarify whether the Order is a rulemaking document for purposes of calculating the date by which any petitions for reconsideration must be filed. In this Public Notice, we clarify that the Order is a rulemaking document for purposes of computing the time within which any petitions for reconsideration must be filed because it amends Parts 20 and 64 of the Commission's rules and incorporates an NPRM. Accordingly, any petitions for reconsideration must be filed within 30 days from the date of publication of a summary of the Order and NPRM in the Federal Register.
