(Contact) filed a consolidated petition to deny Merryville Investments' (Merryville) applications listed below for paging facilities on the 931.2125 Mhz frequency filed under Part 22 of the Commission's rules. On October 25, 1995, Contact submitted a motion to dismiss its petition. The Commercial Wireless Division (Division) has reviewed the petition and finds that it raises no substantial or material questions of fact under Section 309 of the Communications Act, as amended, 47 U.S.C.  309.
