PCIA requests that the Commission forbear from imposing the following on broadband PCS licensees: Section 201; Section 202; Section 226 (TOCSIA); International Section 214; Section 310(d); and, otherwise not impose the resale obligation. 47 C.F.R. 20.12(b). PCIA argues that the statutory criteria for forbearance under Section 10 are met because (1) enforcement of the aforementioned provisions are not necessary to ensure that rates and practices are just, reasonable, and not unreasonably discriminatory; (2) enforcement is not necessary to protect consumers; and (3) forbearance is consistent with the public interest. Interested parties may file comments to the Petition no later than July 2, 1997; reply comments should be filed on or before July 17, 1997. All comments should reference the Petition and this Public Notice and should be filed with the Office of Secretary, Federal Communications Commission, 1919 M Street, N.W., Washington, D.C. 20554.
