Washington, D.C. 20554 R eleased: August 7, 1996 PART 101 - FIXED MICROWAVE SERVICE RULES: CERTAIN ADMINISTRATIVE PROCEDURES AND CLARIFICATION New Fixed Microwave Service Rules are now in effect, as set forth by order in Docket No. 94-148, effective August 1, 1996, 61 FR 26670. These rules, a consolidation of old Parts 94 and 21, prescribe the manner in which portions of the radio spectrum may be made available for private operational and common carrier fixed microwave operations. This notice establishes certain procedures required for the administrative convenience of the Commission and clarifies Rule 101.139. Rule 101.31, Conditional Licensing, envisioned the use of a new FCC form referred to as the Certification Form for use in the conditional licensing process. This form is not available. Instead of the FCC Certification Form, an applicant desiring to take advantage of conditional licensing need only retain and post at the station location a copy of its application together with a self certification signed by the applicant, accepting the conditions of grant and restrictions of use as set forth in 101.31(e). Copies of the certification do not have to be sent to the Commission, and we will neither acknowledge nor retain such copies if they are submitted. In addition, applicants should continue to use the current FCC Forms 402 and 494 until further notice since a revised application form is not yet available. A Public Notice will be released announcing the availability and use of the new form when it is ready for distribution. We also want to clarify the intent and applicability of Rule 101.139 by stating that existing transmitting equipment having received a previous grant of Notification or Type Acceptance under FCC Rule Parts 21 and/or 94 may be licensed at new or existing stations under FCC Rules Part 101. Grants of Notification and Type Acceptance issued for Rules Parts 21 and/or 94 do not need to be re-issued. As a related matter, it remains the responsibility of the station licensee to install a system that will satisfy the applicable channel loading requirements.
