November 6, 1995 WIRELESS TELECOMMUNICATIONS BUREAU RESTATES RULES, ANNOUNCES SEMINAR LOCATION CHANGE AND ADDRESSES ELECTRONIC BIDDING FOR 900 MHz SMR AUCTION Anti-Collusion, Payment, and Electronic Bidding Issues Addressed Report No. AUC-95-08, Auction No. 7 The Federal Communications Commission received 167 FCC Form 175 applications for the 900 MHz Specialized Mobile Radio (SMR) service auction scheduled to commence on November 28, 1995. In this Public Notice, the Wireless Telecommunications Bureau (WTB) provides guidance to those applicants on the Commission's anti-collusion rules and payment requirements, announces a location change for the 900 MHz SMR auction seminar, and addresses several electronic bidding issues. Anti-Collusion Rules The Commission established its anti-collusion rules in order to enhance the competitiveness of the auction process and of the post-auction market structure. The Commission's anti- collusion rules generally require an applicant to identify on its short-form application all parties with whom it has entered into a bidding consortium or other joint bidding arrangement. After the short-form filing deadline, applicants may not discuss the substance of their bids or bidding strategies with bidders, other than those identified on the short-form application, that are applying for the same geographic license areas. 47 C.F.R.  1.2105(c)(1); see Wireless Telecommunications Bureau Clarifies Spectrum Auction Anti-Collusion Rules, Public Notice, DA 95-2244, released October 26, 1995. The WTB reminds 900 MHz SMR applicants that the anti-collusion rules may also apply to individuals who act as bidding representatives for 900 MHz SMR applicants. To the extent that individuals are listed as bidding representatives for more than one applicant who have applied for licenses in the same geographic license area, they may not discuss bids or bidding strategies with more than one applicant, unless the applicants were included in a bidding agreement which was disclosed in Exhibit B of the FCC Form 175. Payment Information The WTB reminds applicants that upfront payments must be made to Mellon Bank by cashier's check or wire transfer only. No other form of payment, including credit card payments and checks, will be accepted. Cashier's checks must be received no later than 11:59 p.m., Monday, November 13, 1995. Wire transfers must be received no later than 3:00 p.m., Monday, November 13, 1995. See 900 MHz SMR Bidder Information Package at page 68. SMR Seminar Location Change The FCC will hold a seminar for 900 MHz SMR applicants on November 9, 1995 at the J.W. Marriott at National Place in Salon III/Ground Foyer, rather than at the FCC Auction Headquarters as indicated on page 5 of the Bidder Information Package. The J.W. Marriott is located at 1331 Pennsylvania Ave., N.W., Washington, D.C. Electronic Bidding Each applicant who wishes to bid electronically must purchase electronic bidding software. Applicants may duplicate the software for backup or for use by authorized representatives at different locations (though not concurrently). However, the FCC Remote Bidding System will not accept electronic bids from applicants who are not registered purchasers of the bidding software. The FCC Remote Bidding System requires access to a 900 telephone line. Applicants should verify in advance that the telephone systems they will be using to submit electronic bids permit access to 900 telephone numbers, and should consult their telephone administrators if they need assistance.
