On August 22, 1995, Cox filed a Reply to PacTel's Opposition. Cox states that the Bureau failed to consider the opportunities for discrimination in interconnection presented by  X-the implementation of PacTel's integrated PCS system.sZ* yO-#C\  P6QIP#э Reply to PacTel Opposition at 12.s To support such allegations of actual and potential crosssubsidization, Cox attaches an audit published in July of 1994 by  X_-the National Association of Regulatory Utility Commissioners ("NARUC").`_* {O -#C\  P6QIP#э  Id. at 3.` Cox alleges that the NARUC audit proves that Pacific Bell has engaged in extensive crosssubsidization  X1-between its landline operations and its affiliated PacTel companies.`1|* {O^-#C\  P6QIP#э Id. at 3.`  X -x7. In a letter to the Commission dated September 18, 1995, PacTel objects to the  X -inclusion of the NARUC audit in Cox's Reply of August 22, 1995.m * yO-#C\  P6QIP#э PacTel Ex Parte Letter at 1.m PacTel argues that Cox  X -improperly presented its alleged proof of crosssubsidization.` * {O$-#C\  P6QIP#э  Id. at 2.` PacTel states that attempting to introduce such proof is procedurally incorrect, as no new evidence may be introduced in an  X -application for review if the designated authority has not yet had an opportunity to review it. 0 * {O-#C\  P6QIP#э  Id.  See also 47 C.F.R.  1.115(a). PacTel also argues that even if such document had been introduced properly, the NARUC report contains only abstract allegations of possible crosssubsidization, and thus presents no  Xb-reason to deny its PCS license.ob * yO-#C\  P6QIP#э PacTel Ex Parte Letter at 13.o x  X4-xpp III. DISCUSSION ă x  X-x8. Under Section 1.115(a) of our rules, a person aggrieved by an action taken  X-pursuant to delegated authority may file an application requesting review of that action.iR * yO#-#C\  P6QIP#э 47 C.F.R.  1.115(a).i "0*%%33'" Such application shall concisely and plainly state the question presented for review, from among the following: x Xx(i) The action taken pursuant to delegated authority is in conflict with statute, regulation, case precedent, or established Commission policy.(# Xx(ii) The action involves a question of law or policy which has not previously been resolved by the Commission.(# Xx(iii) The action involves application of a precedent or policy which should be overturned or revised.(# Xx(iv) An erroneous finding as to an important or material question of fact.(# Xx(v) Prejudicial procedural error.(# x 47 C.F.R.  115(b)(2)(i)(v). In this case, Cox argues that the Bureau erred when it dismissed its Petition to  XK-Deny.rKx* yOt-#C\  P6QIP#э Application for Review at iiiii.r Cox also argues that the Bureau erred when it determined that Cox's allegations of improper crosssubsidization were not supported by evidence, and that therefore no reason  X-existed to deny or condition PacTel's PCS license.m * yO-#C\  P6QIP#э Application for Review at 8.m However, Cox failed to substantiate its  X-claims "with particularity," as required under our rules.i!* yOO-#C\  P6QIP#э 47 C.F.R.  1.115(3).i Cox attempted to support its allegations at the reply stage of its Application for Review through the introduction of the NARUC audit. However, Commission rules clearly state that "no application for review will be granted if it relies on questions of fact or law upon which the designated authority has  X-been afforded no opportunity to pass."i"( * yO#-#C\  P6QIP#э 47 C.F.R.  1.115(c).i This evidence was presented for the first time with" "0*%%33p" the final pleading in an Application for Review, and was not presented to the Bureau for review, despite the fact that it was released in July of 1994, prior to the filing of the Petition  X-to Deny.#* {OK-#C\  P6QIP#э  See Reply to PacTel Opposition at 3, n.4. As this evidence was not considered by the Bureau, we will not consider it here.  X-x 10. We also agree with the Bureau's determination that the issues raised by Cox do not support Cox's petition here. First, PacTel has submitted a safeguards plan pursuant to our  Xv-Broadband PCS Order, which calls for LECs to "implement an acceptable plan for nonstructural safeguards against discrimination and crosssubsidization" prior to commencing PCS  XJ-service.v$\JZ* yOU -#C\  P6QIP#э Amendment of the Commission's Rules to Establish New Personal Communications Services, GEN  {O -Docket No. 90314, Second Report and Order, 8 FCC Rcd 7700, 7748, n.96 (1993), recon. Memorandum  {O -Opinion and Order, 9 FCC Rcd 4957 (1994).v We note that the Bureau recently approved the PacTel plan.%$J~* {Oy-#C\  P6QIP#э See Amendment of the Commission's Rules to Establish New Personal Communications Services, Pacific Bell, Nevada Bell, Pacific Bell Mobile Services and Pacific Telesis Mobile Services' Plan of NonStructural  {O -Safeguards Against CrossSubsidy and Discrimination, GEN Docket No. 90314, DA 96256, Order, __ FCC Rcd __ (rel. Feb. 27, 1996). Second, we intend to initiate a proceeding to review existing competitive safeguard policies and rules for LEC provision of Commercial Mobile Radio Services. We believe that Cox's general concerns regarding proper safeguards to prevent LEC discrimination and crosssubsidization are relevant to the issues under consideration in that proceeding, and we will consider Cox's  X -pleadings as ex parte comments to it.&$ j * yO-#C\  P6QIP#э We note that Cox raised the identical crosssubsidization issues with respect to PacTel's nonstructural  {O-safeguards plan, and that those comments are being included as ex parte comments to the competitive safeguards  {O-rule making, not the reconsideration of the CMRS Second Report and Order, as previously determined in the  {MN-PacTel Order. Also, PacTel will be required to modify its operations and amend its safeguards plan in conformance with any new or amended rules pursuant to this rule making, if applicable, as well as any new rules resulting from the 1996  X-Telecommunications Act, if applicable.'V * {O-#C\  P6QIP#э  PacTel Order, 10 FCC Rcd at 13241,  11. xpp  Xf- }IV. CONCLUSION ă  X8-x 11. Cox does not properly present any evidence that the Bureau erred in its decision  X!-in the PacTel Order. Therefore, as no evidence exist to support this allegation, we deny Cox's Application for Review under Section 309(d)(2) of the Act. Having reviewed the application and the pleadings filed in this matter, we conclude that grant of the subject"'0*%%33" application will serve the public interest, convenience, and necessity, and that the petitioner has not sufficiently alleged facts establishing that grant of the application would be  X-inconsistent with the public interest, convenience, and necessity. x  X-xpppppppp V.
