For Various C-Block Broadband PCS ) Licenses ) ) ORDER Adopted: July 23, 1996 Released: July 23, 1996 By the Acting Chief, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. On May 22, 1996, Nextwave Personal Communications, Inc. (Nextwave), a successful bidder for a license in the broadband C block personal communications services (PCS), filed an FCC Form 600 with the Commission. The Commission released a Public Notice on May 31, 1996, which listed those C block license applications accepted for filing. Petitions to deny any of the listed applications were due on June 30, 1996, oppositions to petitions to deny were due on July 16, 1996, and replies to the oppositions are due on July 26, 1996. 2. On July 1, 1996, Antigone Communications Limited Partnership and PCS Devco, Inc. (Petitioners) filed a Petition to Dismiss or Deny, or Alternatively to Designate for Oral Hearing the grant of Nextwave's C block applications (Petition to Dismiss or Deny). Nextwave filed an opposition to this Petition to Dismiss or Deny on July 16, 1996. On the same day, Nextwave filed an erratum and amendments consisting of an eight page "Second Amended Exhibit A" and a nineteen page "Second Amended Exhibit B" to their earlier-filed FCC Form 600. 3. On July 17, 1996, Petitioners requested a two-week extension of time, until August 6, 1996, in which to reply to Nextwave's opposition. Petitioners state that the five-day reply period is not sufficient to fully review and evaluate the content of the opposition, erratum and amendments and prepare a complete and accurate reply. On July 18, 1996, Nextwave filed an opposition to the request for an extension of time, contending that the Petitioners have not met their burden to justify such extraordinary relief and that Nextwave will be prejudiced by the delay. 4. We concur with Petitioners that the time remaining in the comment period is insufficient for commenters to review and respond to Nextwave's erratum and amendments, because the erratum and amendment relate directly to the subject matter of Nextwave's FCC Form 600. We therefore find that, in order to allow Petitioners to respond adequately to Nextwave's erratum and amendments, a brief extension of time is in the public interest. We therefore grant Petitioner's request for an extension. Accordingly, it is ORDERED that, pursuant to Section 1.46 of the Commission's rules, 47 C.F.R.  1.46, that the deadline for filing a Reply in this proceeding IS EXTENDED to August 6, 1996.
