Fortner ) ) Finder's Preference Request ) File No. 93F631 for Station KNHK827 ) Licensed to J.E. Sussman ) d/b/a Fox Systems ) Clayton, Ohio ) MEMORANDUM OPINION AND ORDER Adopted: October 18, 1999 Released: October 21, 1999 By the Commission: 1. The Commission has before it an Application for Review, filed on March 5, 1997 by Charles W. Fortner ("Fortner"). Fortner seeks review of a decision by the Wireless Telecommunications Bureau ("Bureau"), denying Fortner's Petition for Reconsideration of a grant of a finder's preference to Fortner for three of the five frequencies associated with Station KNHK827. 2. Fortner presents no arguments in its Application for Review that would lead us to change the Bureau's decision. We therefore affirm the Bureau's decision for the reasons stated therein. 3. ACCORDINGLY, IT IS ORDERED that, pursuant to Section 5(c)(5) of the Communications Act, as amended, 47 U.S.C. 155(c)(5), and Section 1.115(g) of the Commission's rules, 47 C.F.R. 1.115(g), the Application for Review filed by Fortner on March 5, 1997 in the above-captioned proceeding IS DENIED.
