ЇEUiscorrectinstatingthattheCommissionisrequiredtomakerefundsofupfrontpaymentstothe"payorofrecord."EU,however,isincorrectinassertingthatMr.Pruettisthe"payorofrecord."The"payorofrecord"istheindividualorentitydesignatedontheFCCForm159asthe"Payor."Ineachofthe25auctionsconductedthusfar,theCommissionhasreliedoninstructionsfromthe"Payor"regardingrefundsofexcessupfrontpaymentamounts.TheFCCForm159mustbesubmittedtotheCommissionwithvirtuallyallauctionsrelatedpayments.Clearly,instatingthatwewillrefundexcessupfrontpaymentstothe"payorofrecord,"wearereferringtothe"Payor"identifiedonForm159.Inthiscase,EU'sForm159specificallydesignatedRaveeshK.Kumraasthe"Payor."Thus,Mr.Kumraisthe"payorofrecord,"andtheCommission,inaccordancewithitsownpoliciesandprocedures,properlyreliedonMr.Kumra'sinstructionsinrefundingtohimtheexcessupfrontpaymentamountof$1,777,250.ContrarytoEU'sassertions,the"payorofrecord"isnottheindividuallistedonanapplicant'sshortformapplicationasthe"ContactPerson."The"ContactPerson"onanapplicant'sFCCForm175istheindividualtowhomregistrationinformationandCommissionquestionsaboutanapplicant'sForm175aredirected.Ifwehadintendedtorelyonthe"ContactPerson"inmattersrelatedtotherefundofexcessupfrontpayments,wewouldhavespecificallyreferencedthe"ContactPerson"asopposedtothe"payorofrecord." thepurposeofreceivinginstructionsregardingtherefundoftheexcessupfrontpayment.PursuanttoSection309(j)(8)(C)oftheCommunicationsAct,theCommissionhas45daysfollowingtheconclusionofanauctiontoeithertransferthedepositsofsuccessfulbidderstotheTreasuryorreturnthedepositsofunsuccessfulbidderstosuchbidders..   22      ׀Ordinarily,bidderscontacttheCommissionshortlyafteran `  auctionclosestorequestarefundoftheirdepositsortodirectthatsuchdepositsbeappliedtothebalancesowedtheCommission.Insomeinstances,however,whenasignificantperiodoftimehaselapsedafterthecloseofanauction,andtheCommissionhasnotreceivedinstructionsonhowtohandlethedeposits,itcontactsthe"payorofrecord."TheCommissiontakesthisaffirmativestepbecauseunderthestatuteitmayretainbidders'depositsforonly45daysafteranauctioncloses.Inthisinstance,AuctionNo.22closedonApril15,1999.Formorethanamonthaftertheauctionclosed,neitherthe"ContactPerson"noranyotherEUrepresentativecontactedtheCommissionwithdirectionsconcerningtheexcessupfrontpaymentretainedbytheCommission.Finally,onMay27,1999,theCommissioncontactedthe"payorofrecord,"Mr.Kumra,toreceiveinstructionsconcerningthispayment.SuchactiononthepartoftheCommissionwasnecessitatedbyitsstatutoryobligationsandiswhollyconsistentwithitsstatedprocedures.  9. ` Finally,EU'sclaimsthatitbelievedtheexcessupfrontpaymentamountof$1,777,250 #8" wasintheCommission'spossessionandthatitintendedtopaybythefinalpaymentdeadlinethefullamountowedonitstwoCblocklicensesarenotsupportedbythefacts.EUowedafinalpaymentamountof$2,091,000onthelicenses.IfEUbelievedthattheCommissionhadretainedthe$1,777,250amount,EUsimplycouldhavewiretransferred$313,750totheCommissioninanefforttomakefullandtimelypaymentonthelicenses.WhileEUstatesthatitintendedtowiretheCommissionthisamount,itneverdid.EUdidnotmakefinalpaymentonitslicensesuntilJuly9,1999,twoweeksafterthefinalpaymentduedate.EUdoesnotexplainwhyitdidnot,ataminimum,paythe$313,750amount inlightofitsbeliefthattheCommissionhadretainedtheexcessupfrontpaymentandEU'sintentiontopaytheremainingbalanceowedonthelicensesbythefinalpaymentdeadline.Instead,EUblamestheCommissionforitsfailuretomaketimelypaymentonthelicenses.TheCommissionisnotatfaultwhenanentitymissesapaymentdeadlineduetointernalcoordinationproblemsamongpersonnelconnectedwiththeentity.
