On May 15, 1995, San Diego Paging, Inc. (SDP) and Tri-State Radio Co., Inc. (TSR) (collectively, Tri-State) filed a request for immediate dismissal (Dismissal Request) of the above-captioned applications of Pellish Communications, Inc. (Pellish) for private carrier paging (PCP) facilities on frequency 929.2125 MHz at multiple locations in the State of New York. For the reasons discussed below, we dismiss Tri-State's Dismissal Request as moot. 2. On April 5, 1996, counsel for Tri-State filed with the Commercial Wireless Division, Wireless Telecommunications Bureau (Division), a letter executed by Pellish authorizing the dismissal with prejudice of Pellish's above-referenced pending applications for 929.2125 MHz PCP facilities. Because the applicant has asked for dismissal of its own applications, the Dismissal Request filed by Tri- State is moot and is hereby dismissed. 3. Accordingly, IT IS ORDERED that, pursuant to section 4(i) of the Communications Act, as amended, 47 U.S.C.  154(i), and by section 0.331 of the Commission's rules, 47 C.F.R.  0.331, the request for dismissal, filed by San Diego Paging, Inc. and Tri-State Radio Co., Inc., on May 15, 1995, IS DISMISSED as moot.
