This Order grants the petition for reconsideration (Petition), filed by USA Mobile Communications, Inc. II (USA Mobile) on April 25, 1996, of an action taken by the Commercial Wireless Division's Narrowband Branch (Branch). 2. On March 27, 1996, the Branch terminated USA Mobile's construction permit pursuant to section 22.144 of the Commission's rules on the ground that USA Mobile failed to notify the Branch of completion of modifications to its facility. USA Mobile sought reconsideration of the termination and provided information that it had properly notified the Branch of the completion of modifications. In response to the Petition, the Branch determined that USA Mobile had timely filed its FCC Form 489 notification, reinstated the construction permit and, on June 18, 1996, licensed the station. The Petition, however, was not formally granted. Because the Petition technically remains pending, we formally grant the Petition by this Order. 3. Accordingly, IT IS ORDERED that, pursuant to authority delegated by sections 4(i) and 405 of the Communications Act, as amended, 47 U.S.C  154(i), 405, and by sections 0.331 and 1.106 of the Commission's rules, 47 C.F.R  0.331, 1.106, the petition for reconsideration filed by USA Mobile Communications, Inc.
