On May 30, 1997, Radiofone, Inc. (Radiofone) filed a request for stay (Request for Stay) of the effectiveness of: (a) the dismissals of Radiofone's captioned applications for additional 929.6875 MHz paging facilities; (b) the denial of Radiofone's waiver request that would have made it possible for Radiofone to expand its 929.6875 MHz regional paging system; and (c) any auctions involving these licenses and/or the frequency 929.6875 MHz. On June 10, 1997, Greenline Partners, Inc. (Greenline) filed a Partial Opposition to the Request for Stay. For the reasons discussed below, we dismiss Radiofone's Request for Stay as moot. 2. Radiofone requests the stay pending action of its petition for partial reconsideration filed on April 22, 1997 (April 22 Petition). In the April 22 Petition, Radiofone sought reconsideration of a March 24, 1997 decision by the Licensing Division of the Land Mobile Branch (Branch), Private Radio Bureau, denying Radiofone's request for a waiver of the paging expansion provisions as established by the Commission's First Report and Order, in WT Docket No. 96-18, released April 23, 1996. That petition was denied on September 21, 1999. 3. Radiofone also requests the stay pending action of nine petitions seeking reconsideration of the Branch's decision to dismiss the captioned applications. In those petitions for reconsideration, Radiofone argued that the Branch should not have dismissed the applications, but, instead, should have retained them as pending until final disposition of Greenline's waiver request. Those nine petitions for reconsideration were denied on October 8, 1999. Accordingly, the Request for Stay is dismissed as moot. 4. Accordingly, IT IS ORDERED that, pursuant to authority delegated by section 4(i) of the Communications Act, as amended, 47 U.S.C. 154(i), and by sections 0.331 and 1.43 of the Commission's rules, 47 C.F.R. 0.331, 1.43, the Request for Stay filed by Radiofone, Inc. on May 30, 1997, IS DISMISSED as moot.
