On June 9, 1997, Radiofone, Inc. (Radiofone) filed a request to stay (Request to Stay) of the effectiveness of: (a) the denial of Radiofone's Waiver Request that would have made it possible for Radiofone to expand its 929.6375 MHz regional paging systems; and (b) any auctions involving these licenses and/or the frequency 929.6375 MHz. For the reasons discussed below, we dismiss Radiofone's Request for Stay as moot. 2. Radiofone requests the stay pending action of its petition for partial reconsideration (Petition) filed on April 22, 1997. In the Petition, Radiofone sought reconsideration of a March 24, 1997 decision by the Licensing Division of the Land Mobile Branch (Branch), Private Radio Bureau, denying Radiofone's request for a waiver of the paging expansion provisions as established by the Commission's First Report and Order (Order), in WT Docket No. 96-18, released April 23, 1996. That petition was denied on September 21, 1999. Accordingly, the Request for Stay is dismissed as moot. 3. Accordingly, IT IS ORDERED that, pursuant to authority delegated by section 4(i) of the Communications Act, as amended, 47 U.S.C.  154(i), and by sections 0.331 and 1.43 of the Commission's rules, 47 C.F.R.  0.331 and 1.43, the Request for Stay filed by Radiofone, Inc. on June 9, 1997, IS DISMISSED as moot.
