Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of ) ) PAGING NETWORK OF FLORIDA, INC. ) ) Request for Regional Exclusivity in the States ) of Arkansas, Florida, Georgia, Mississippi, ) North Carolina, South Carolina, Tennessee ) and Virginia on Frequency 929.1375 MHz ) ORDER Adopted: October 14, 1999 Released: October 14, 1999 By the Deputy Chief, Policy and Rules Branch, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. On September 26, 1994, MobileMedia Communications, Inc. (MobileMedia) filed a Petition to Limit Grant of Regional Exclusivity (Petition) of Paging Network of Florida, Inc. (PageNet). For the reasons discussed below, we dismiss the Petition. 2. At the time the Petition was filed, MobileMedia and PageNet were developing nationwide and regional systems, respectively, on 929.1375 MHz. Having considered MobileMedia's arguments and supporting facts, we determine that it has failed to make a prima facie showing that PageNet request for exclusivity is inconsistent with the Commission's regional exclusivity rules or that the Commission was failing to follow those rules. Further, on May 10, 1996, after the filing of this Petition, the Commission granted MobileMedia national exclusivity on frequency 929.1375. Accordingly, we dismiss the Petition. 3. Accordingly, IT IS ORDERED that pursuant to authority delegated by sections 4(i) of the Communications Act, as amended, 47 U.S.C. 154(i), and by section 0.331 of the Commission's rules, 47 C.F.R. 0.331 the Petition to Limit Grant of Regional Exclusivity filed by MobileMedia Communications, Inc. on September 26, 1994, IS DISMISSED.
