Burns, Chief of Police, Henderson, Nevada to FCC (dated May  x7 10, 1998)). Henderson does not contend that it included any FCC application form and we have no record of our receipt of such a letter. >  "5. On October 5, 1998, Henderson determined that the FCC had not received its letter of May  y_' xZ10, 1998, and that the license for Station WNER752 had expired.7 nZ 'ԍId. at 2.7 That same day, Henderson applied  y_' xQfor and received Special Temporary Authority to operate the station.Sx nZ 'ԍId. See 47 C.F.R.  1.931.S On November 6, 1998, Henderson  y_' xfiled an application to reinstate its license for Station WNER752.> nZC'ԍHenderson Application.> In the accompanying cover letter,  y_h'Henderson asks that the license be reinstated with primary status.9h nZ'ԍHenderson Letter.9  y_'F III. DISCUSSION ă   "R6. The Commission has recently adopted a new policy regarding reinstatements in the wireless  y_i ' x7services. i (  nZ1' xI ԍBiennial Regulatory Review Amendment of Parts 0, 1, 13, 22, 24, 26, 27, 80, 87, 90, 95, 97, and 101 of  xt the Commission's Rules to Facilitate Development and Use of the Universal Licensing System in the Wireless  nZ' xo Telecommunications Service, Memorandum Opinion and Order on Reconsideration, FCC 99139,  2122 (rel. June  nZ'28, 1999) (ULS Reconsideration MO&O).  Renewal applications that are filed up to thirty days after the expiration date of the license will  y_6 ' x3generally be granted nunc pro tunc, although the licensee may be subject to an enforcement action for  xtuntimely filing and unauthorized operation during the time between the expiration of the license and the  y_ ' xuntimely renewal filing.=  nZ'ԍId. at  22.= Applicants who file renewal applications more than thirty days after the license  y_ ' xpexpiration may also request that the license be renewed nunc pro tunc but such requests will not be  xroutinely granted, will be subject to stricter review and also may be accompanied by enforcement action,  y_7' xtincluding more significant fines or forfeitures.17 nZw 'ԍId.1 In determining whether to reinstate an application, we  xtake into consideration all of the facts and circumstances, including the length of the delay in filing, the  xreasons for the failure to timely file, the potential consequences to the public if the license should  y_' xterminate, and the performance record of the licensee.10 nZn$'ԍId.1 Because Henderson's application for reinstatement is pending, we will consider whether it should be granted under the new policy.  "7. Taking into account all of the facts and circumstances, including the specific factors set forth  xby the Commission, we conclude that Henderson's license should be reinstated. With regard to the first",l(l(,,"  xZtwo factors set forth by the Commission length of the delay and the reasons for failing to timely file  x-- although Henderson's request for reinstatement was made approximately four and a half months after  xits license expired, we nonetheless believe that the unusual circumstances of this case justify our  y_g' xkreinstating Henderson's license nunc pro tunc. Particularly relevant is that Henderson did not simply allow  xits license to lapse but, after not receiving a renewal form from the FCC as it had expected, attempted to  xrenew the license in a timely fashion. While such facts do not excuse Henderson from timely filing a  y_' xproper renewal application,N  nZ6' x ԍAs Henderson acknowledges, it is the responsibility of each licensee to apply to renew its license prior to the  nZ' x license's expiration date. Henderson Letter at 2; see Daniel R. Goodman, Receiver, Dr. Robert Chan, Petition for  nZ' x Waiver of Sections 90.633(c) and 1.1102 of the Commission's Rules, Memorandum Opinion and Order and Order  nZ ' xo on Reconsideration, 13 FCC Rcd 21944, 2197273 (1998) (Goodman/Chan Reconsideration). The Commission sends  xQ Part 101 licensees renewal applications, form FCC 402R, but if a licensee does not receive the renewal application  x at least 60 days prior to the license's expiration date, the licensee should use form FCC 415 to renew the license,  x specifying "Renewal only, no 402R available." Thus, contrary to Henderson's  x arguments, Henderson Letter at 2, its failure to receive a renewal form from the Commission does not excuse it from  nZ' x timely renewing its license. Further, requests  x for license renewal must be filed on the proper application form; a request made in a letter is insufficient. 47 C.F.R.  nZ' x  1.911, 101.9 (1998) (currently 47 C.F.R.  1.913, 1.915); see also 47 C.F.R. 101.13 (1998). Nor is Henderson  nZ' xx correct in arguing, see Henderson Letter at 2, that upon receiving Henderson's letter, the Bureau was obligated to  x contact Henderson to inform it of the correct steps to take to renew its license. Again, the responsibility to timely renew its license was Henderson's. N they do reflect good faith efforts on Henderson's behalf to retain the license  x7for Station WNER752. With regard to the last factor, we find that there would be adverse consequences  xMto the public if the license were to lapse. Reinstating the license will allow Station WNER752 to retain  xprimary status, while not reinstating the license and requiring Henderson to acquire a new license would  y_' xMaccord the new station secondary status under the Commission's licensing rules for the 2 GHz band.>h nZ 'ԍ47 C.F.R.  101.81.>  xHenderson states that Station WNER752 is at the "heart" of its public safety communications system,  xwhich includes the entire Police, Fire, and Public Works Departments as well as other local government  y_i 'agencies, and that not granting the station primary status would render this system useless.>i  nZ'ԍHenderson Letter at 2.>  "+8. We also find that other factors militate in favor granting Henderson's reinstatement request.  xWe note that Station WNER752 had primary status until June 8, 1998, at which point Henderson  xinadvertently allowed the license to lapse. Thus, prior to such date, future ET licensees would have had  xto pay to relocate Station WNER752, in addition to having to pay to relocate Henderson's two other 2  xGHz stations which still retain primary status. While denying Henderson's reinstatement request would  xcause Station WNER752 to be treated as a "new" facility under the Commission's Rules, granting a license  xtfor the station would not actually expand Henderson's network beyond what was originally authorized.  y_' xWe conclude, therefore, that allowing the license for Station WNER752 to be reinstated nunc pro tunc and  x3retain primary status will not place a future ET licensee in any worse a position than if Henderson had timely renewed the license for Station WNER752.
