This Order grants a petition for reconsideration (Petition), filed by Pellish Communications, Inc. (Pellish) on May 7, 1999, of an action taken by the Commercial Wireless Division's Licensing and Technical Analysis Branch (Branch). 2. On October 30, 1995, Pellish and TSR Paging, Inc. (TSR) entered into a Settlement Agreement (Agreement) which resulted in TSR assigning certain of its authorizations to Pellish. The Agreement further provided that Pellish would submit a minor amendment to substitute Pellish as the applicant with respect to four pending TSR applications for operation on the 931.0875 MHz frequency, including an application for Lewistown, Pennsylvania. The Commission approved the assignment of these authorizations on January 26, 1996. On April 11, 1996, in accordance with the Agreement and with section 22.123(a) of the Commission's rules, Pellish submitted a minor amendment to TSR's pending Lewistown application. The Branch has never acted upon this minor amendment. The application for Lewistown was granted by the Branch on March 29, 1999, but it was granted in the name of TSR, rather than Pellish. 3. On May 7, 1999, Pellish filed the instant Petition seeking reconsideration of the grant and reissuance of the above-captioned authorization with Pellish listed as the licensee of record. In its Petition, Pellish argues that the above referenced minor amendment was proper under section 22.123(a) as an amendment to reflect a change in ownership that had previously been approved by the Commission. We agree. Because this amendment was in accordance with section 22.123(a), we hereby grant Pellish's Petition. 4. Accordingly, IT IS ORDERED that, pursuant to sections 4(i) and 405 of the Communications Act, as amended, 47 U.S.C  154(i), 405, and by sections 0.331 and 1.106 of the Commission's rules, 47 C.F.R  0.331, 1.106, the petition for reconsideration filed by Pellish on May 7, 1999, IS GRANTED.
