In this Order we grant a motion filed by complainant Global Connect, Inc. ("Global") to dismiss its above-captioned formal complaint against defendant 360 Communications, Inc. ("360"). We conclude that the public request would be served by dismissing the complaint and terminating this proceeding. 2. This case was initiated on November 27, 1997, when Global filed the captioned formal complaint against 360 pursuant to Section 208 of the Communications Act of 1934, as amended. Global alleged that 360 had improperly terminated the provision of cellular radio telephone service which Global used to facilitate access by its customers to its internet provider service. Global contended that such termination of service by 360 violated Section 201 of the Communications Act and Section 22.901 of the Commissions Rules. On September 9, 1999, Global filed the instant motion to dismiss its complaint. 3. We find that dismissal of the complaint and termination of this proceeding would serve the public interest. Dismissal at this time will preclude the need for further litigation and conserve Commission resources. 4. ACCORDINGLY, IT IS ORDERED that, pursuant to Sections 4(i), 4(j) and 208 of the Communications Act of 1934, as amended, and Section 0.321 of the Commissions Rules, the motion by Global to dismiss its complaint IS GRANTED. 5. IT IS FURTHER ORDERED that the above-captioned formal complaint, filed on November 27, 1997, by Global Connect Inc. IS DISMISSED WITH PREJUDICE. 6.
