On October  S,15, 1998, Astrolink, Microwave's successorininterest,2 Є {Oo,ԍSee Microwave's proforma assignment to Astrolink Communications, Inc., (granted on Nov. 26, 1996). filed a Request to Withdraw its petition as to the Columbus, Ohio application, explaining that Astrolink and No Wire amended their applications to  S7,eliminate the mutual exclusivity.Y7 Є {O,ԍSee Astrolink Request at 1 (Oct. 15, 1998).Y On March 10, 1999, the Branch dismissed amendments to three of  S,No Wire's applications, including its September 23, 1998 amendment to the Columbus application, V Є yO, wԍLetter from Mary Shultz, Chief, Licensing and Technical Analysis Branch to Frederick R. Adler, Manager, No  wWire L.L.C. (Mar. 10, 1999). The Branch dismissed No Wire's September 23, 1998 amendments to its Columbus,  wOhio application (FCC File No. 9509049), its Fort Wayne, IN application (FCC File No. 9509046) and its Columbia, SC application (FCC File No. 9509297). because the amendments were filed after the December 15, 1995 deadline for filing amendments of right.  S8 ,5. On April 9, 1999, No Wire filed with the Commission a Petition for Reconsideration of the Branch's dismissal of the amendments to three of its applications. No Wire makes the same argument concerning its amendments to its Columbus, OH application (FCC File No. 9509049) and its Fort Wayne, IN application (FCC File No. 9509046).  In a July 29 MO&O that addressed the outstanding petitions  S;,for reconsideration, the Commission upheld the application processing policy set forth in the Report  S ,and Order and Second NPRM.b Є {O',ԍSee July 29 MO&O, FCC 99179,  2938. b As a result, we conclude that the Commission's action renders No" ,l(l(,," Wire's first argument moot. No Wire next argues that the freeze on amendments of right should not be a bar to the Branch's acceptance of its amendments of right "since these amendments do not  S,conflict with the purpose of new rules and do not undercut the policies they reflect.";Є {O,ԍSee id. at 3.; We disagree. At the outset of the 39 GHz rule making proceeding, the Bureau explained that the applications that were tendered were not necessarily in conformance with application and technical requirements that  S,were under consideration for the band.YZЄ {O,ԍFreeze Order, 11 FCC Rcd 1156 (1995).Y Further, we note that this approach is consistent with the  S,decision and reasoning in the Commission's July 29 MO&O concerning amendments of right.bЄ {OZ ,ԍSee July 29 MO&O, FCC 99179,  2938. b 6. Consequently, we affirm the Branch's dismissal of the amendments to No Wire's  S6,applications as unacceptable for filing in accordance with the Report and Order and Second NPRM,  S,and dismiss No Wire's April 9, 1999 Petition for Reconsideration.o~Є {O",ԍReport and Order and Second NPRM, 12 FCC Rcd 18600, 18641 (1997).o We also dismiss No Wire's April  S,18, 1997, Columbus amendment for the same reason.Є yO, wgԍIn addition, we affirm the Branch's dismissal of No Wire's September 23, 1998 amendment to the Columbia,  wSC application, FCC File No. 9509297, because it was filed after the December 15, 1995 deadline for filing  {O, w>amendments of right as set forth in the NPRM and Order, 11 FCC Rcd 4930, 1989 (1995). Those latefiled  {O, wamendments of right were subsequently dismissed in the Jan. 17 MO&O, 12 FCC Rcd 2910, 2918 (1997) and the  {O,dismissal was affirmed in the July 29 MO&O, FCC 99179,  2938. In addition, we deny Astrolink's request to withdraw and dismiss, without prejudice, the Microwave and No Wire Columbus, OH applications as  Sk ,to Channel 9 on the basis of mutual exclusivity, in accordance with the Report and Order and Second  S9 ,NPRM.?9 ƶ {O,ԍSee id. at 18641.? As noted above, the Microwave Petition is moot. As a result, we dismiss Microwave's  S ,Petition in accordance with Section 1.939(g) of the Commission's Rules.
