Lewis, Miwuk Village, ) Toulumne, California ) ORDER OF MODIFICATION Adopted: August 30, 1999 Released: August 31, 1999 By Chief, Public Safety and Private Wireless Division, Wireless Telecommunications Bureau: 1. On August 6, 1998, the Licensing and Technical Analysis Branch, Public Safety and Private Wireless Division granted an application filed by Columbia Communications, Inc. (Columbia) seeking modification of its authorized facilities to operate on Channel 460.725 MHz under Call Sign WNEC557 at Mt. Lewis, Miwuk Village, Toulumne, California at a power level of 40 watts. The maximum authorized power for a station operating on Channel 460.725 MHz is 20 watts. Consequently, pursuant to Section 316 of the Communications Act, as amended, we are notifying you that effective September 30, 1999, you may no longer operate Station WNEC557 at a power level of 40 watts. Consistent with Section 90.35 of the Commission's Rules, the maximum power for Station WNEC557, which you may begin using immediately, will be 20 watts. 2. In accordance with Section 1.87 of the Commission's Rules, this Order of Modification, will not become final until you have received notice of our action and an opportunity to protest the modification. While Section 1.87(a) generally provides for a thirty-day period to protest a license modification, where safety of life or property is involved, we may provide a shorter period of time. Because issues concerning the safety of life or property are not involved, we are providing you with thirty days notice of our action to modify the license for Station WNEC557 to reduce the operating power from 40 watts to 20 watts to comply with the Commission's Rules. 3. You may protest the modification of your license if, within thirty days of the release of this Order of Modification, you submit a written statement with sufficient evidence to show that the proposed modification would not be in the public interest. Your protest must be filed with the Federal Communications Commission, Office of the Secretary, 445 Twelfth Street, S.W., Washington, D.C. 20554. Additionally, your protest shall be subject to the requirements of Section 309 of the Communications Act of 1934, as amended, for petitions to deny. If you do not file a protest within thirty days of the release date of this Order of Modification, your right to file a protest will be deemed waived and you will be deemed to have consented to the proposed modification. Your right to file a protest shall be deemed waived unless good cause is shown in a petition to be filed not later than five days before the lapse of the thirty-day protest period. 4. IT IS ORDERED, pursuant to sections 4(i) and 316 of the Communications Act of 1934, as amended, 47 U.S.C.  154(i), 316, and section 1.87 of the Commission's Rules, 47 C.F.R.  1.87 that the Order of Modification shall become effective on September 30, 1999 Columbia Communications, Inc. does not protest the Order of Modification. 5. IT IS FURTHER ORDERED pursuant to section 4(i) Communications Act of 1934, as amended, 47 U.S.C.  154(i), and section 1.87(i) of the Commission's Rules, 47 C.F.R.  1.87(i) that the Order of Modification shall be served by certified mail, return receipt requested upon Columbia Communications, Inc.
