File No. 0000001564 ) For Reconsideration of Authorizations) for Facilities in the 931 MHz Band) in the Paging and Radiotelephone Service) ORDER ON RECONSIDERATION Adopted: August 30, 1999 Released: August 30, 1999 By the Chief, Policy and Rules Branch, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. This Order grants a petition for reconsideration (Petition), filed by Paging Network of Los Angeles, Inc. (PageNet) on October 9, 1998, of an action taken by the Commercial Wireless Division's Licensing and Technical Analysis Branch. PageNet seeks reconsideration of the decision to dismiss the above- captioned application for failure to pay the applicable filing fee. For the reasons discussed below, we grant the Petition. 2. In May 1998, PageNet filed the above-captioned application and included a payment of forty- five dollars. In its Petition, PageNet argues that it filed the FCC Form 489 application to notify the Commission that it has "constructed and placed in operation or modified existing facilities authorized under Construction Permit No. 29945-CD-P/ML-96." PageNet's FCC Form 489 states that the modifications consist of a correction of coordinates for the facility located at 351 Hospital Road, NewPort Beach, California. The information included in PageNet's application demonstrates that PageNet constructed its facility at the address authorized in its construction permit. The coordinate correction, therefore, constitutes a minor amendment. At the time PageNet filed its application, the schedule of charges for paging applications in section 1.1102 of the Commission's rules required PageNet to pay a fee of forty-five dollars for a minor modification. We therefore grant PageNet's Petition. 3. Accordingly, IT IS ORDERED that, pursuant to sections 4(i) and 405, of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 405, and sections 0.331 and 1.106 of the Commission's Rules, 47 C.F.R. 0.331, 1.106, the petition for reconsideration filed by Paging Network of Los Angeles, Inc. IS GRANTED. FEDERAL COMMUNICATIONS COMMISSION Paul D'Ari Chief, Policy and Rules Branch Commercial Wireless Division Wireless Telecommunications Bureau
