File Nos. 0000001302, et al. ) For Reconsideration of Authorizations) for Facilities in the 931 Mhz Band) in the Paging and Radiotelephone Service) ORDER ON RECONSIDERATION Adopted: August 30, 1999 Released: August 30, 1999 By the Chief, Policy and Rules Branch, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. This Order dismisses eight identical petitions for reconsideration (Petitions), listed in Attachment A, of actions taken by the Commercial Wireless Division's Licensing and Technical Analysis Branch. Paging Network of Los Angeles, Inc. (PageNet) filed eight applications that were dismissed for failure to pay the applicable filing fees and it now seeks reconsideration of the dismissals. For the reasons discussed below, we deny the Petitions. 2. In May 1998, PageNet filed the eight applications listed in Attachment A and included a payment of forty-five dollars. In its Petitions, PageNet argues that it filed FCC Form 489 applications to notify the Commission that it has "constructed and placed in operation or modified existing facilities authorized" under the relevant construction permits. All of the applications, however, provided information that PageNet had constructed at sites other than where it was authorized to construct. Four of the FCC Form 489 applications state that the modifications consist of corrected addresses and coordinates. For example, the construction permit for File No. 30957-CD-P/ML-96 reflects an address of 2610 Elping Road with coordinates 32-33-14 and 116-47-3. The Form 489 for that construction permit relocates the facility to 1453 Star Valley Road (32-49-52 116-43-00). In the other applications, PageNet states that the "modifications consist of the relocation of the granted site." PageNet also submitted an FCC Form 600 with each application to reflect the changes in location of the authorized sites. The information included in PageNet's applications demonstrate that PageNet intended to notify the Commission of its construction and operation of fill-in transmitters. At the time PageNet filed its applications, the schedule of charges for paging fill-in transmitter applications contained in section 1.1102 of the Commission's rules required PageNet to pay a fee of two-hundred eighty dollars. PageNet's applications were submitted with only a forty-five dollar fee per application. Accordingly, because PageNet failed to submit the proper payment for the applications, we deny the Petitions listed in Attachment A. 3. Accordingly, IT IS ORDERED pursuant to sections 4(i) and 405, of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 405, and sections 0.331 and 1.106 of the Commission's Rules, 47 C.F.R. 0.331, 1.106, the petitions for reconsideration listed in Attachment A of this Order ARE DENIED.
