Before the Federal Communications Commission Washington, D.C. 20554 In re Applications of ) ) Geotek Communications, Inc. ) File Nos. 0000013499, et al. ) File Nos. 911833, et al. To for Consent to Assign 900 MHz ) Specialized Mobile Radio Licenses ) ORDER Adopted: July 16, 1999 Released: July 16, 1999 By the Chief, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. On July 9, 1999, Mobex Communications, Inc. ("Mobex") filed a motion requesting an extension of time to file reply comments in the above-captioned proceeding. Pursuant to the Public Notice announcing the acceptance for filing of the subject applications, petitions to deny the applications were due on June 28, 1999, oppositions on July 8, 1999, and replies on July 15, 1999. Mobex timely filed a petition to deny. 2. On July 1, 1999, Nextel Communications, Inc., the proposed assignee, requested an extension of time until July 15, 1999 in which to file its opposition, and suggested a new reply date of July 22, 1999. Mobex did not oppose that request, but rather agreed that an extension was appropriate in light of the complexities of this case and the parties' desire to engage experts to review issues raised by the various petitioners. The Commission verbally granted Nextel's request and extended the opposition due date to July 15, 1999. 3. Mobex requests until July 30, 1999 to file its reply in this matter and states that, in addition to needing extra time to obtain an expert opinion, additional time would be helpful in light of the need to reconcile actions in several parallel proceedings involving Nextel. Geotek, the current licensee and proposed assignor to Nextel, opposes the Mobex Motion, stating that Mobex cannot know whether it will need extra time until it reviews the filings in the parallel proceedings and that the additional delay is unnecessary in light of Geotek's need to move its Chapter 11 to conclusion. 4. Our rules do not provide for routine grants of extensions of time. In this case, however, we find that a brief extension for the reasons cited by Mobex would allow a more complete and responsive record in this proceeding, while interposing only minimal delay to Geotek's reorganization proceeding. Further, Geotek has not stated that any deadlines in its Chapter 11 proceeding would be threatened by extending the date for replies in this proceeding by an additional week. We therefore grant Mobex's request and extend the deadline for filing reply comments in this proceeding to July 30, 1999. 5. Accordingly, IT IS ORDERED, pursuant to sections 0.131, 0.331 and 1.46 of the Commission's rules, 47 C.F.R. 0.131, 0.331, 1.46, that the Motion for Extension of Time in Which to File Reply Comments, filed by Mobex Communications, Inc. IS GRANTED. FEDERAL COMMUNICATIONS COMMISSION Steven E. Weingarten Chief Commercial Wireless Division Wireless Telecommunications Bureau
