On August 2, 1996, Gulf Telephone Company (Gulf) filed a petition to dismiss or deny the application of Communitronics, Inc. to expand its service area (152.63 MHz) for Station KNLS237, Foley, Alabama. Pursuant to section 22.912(b) of the Commission's rules, 47 C.F.R.  22.912(b), the parties entered into an agreement in which they agreed to coordinate their respective operations on the 152.63 MHz frequency at Mobile Alabama (KNLS237), Foley Alabama (KIB529) and Bay Minette, Alabama (KIB528). This agreement further provided that Gulf agrees to accept technical interference between and among these operations. As a result of this agreement, the issues raised by Gulf in its petition to dismiss or deny are moot. 2. Accordingly, IT IS ORDERED, that, pursuant to sections 4(i) and 309 of the Communications Act, as amended, 47 U.S.C.  154(i), 309, and pursuant to sections 0.331, 22.130(c), and 22.912(b), the Petition to Dismiss or Deny filed by Gulf Telephone Company is Dismissed as moot without prejudice.
