G   ׀Nonetheless,sincethefactorsPSEreferstoarethetypesoffactorsthattheCommissionwouldhavetoconsiderunderSection503(b)(2)(D)oftheAct H   ׀inanyinstance,wewillconsidertheirarguments.Section503(b)(2)(D)oftheAct I   ׀states:8..TheamountofsuchforfeiturepenaltyshallbeassessedbytheCommission,oritsdesignee,bywrittennotice.Indeterminingtheamountofsuchaforfeiturepenalty,theCommissionoritsdesigneeshalltakeintoaccountthenature,circumstances,extent,andgravityoftheviolationand,withrespecttotheviolator,thedegreeofculpability,anyhistoryofprioroffenses,andsuchothermattersasjusticemayrequire.Thelanguageofthestatuteclearlypresupposesthataforfeiturewillbeissuedbecauseitstatesthatthefactorsitlistswillbeconsideredindeterminingtheamountofaforfeiture.PSE'sargumentthataforfeiturecannotbeissuedunlessaggravatingfactorsarepresentisthusinconsistentwiththelanguageofthestatute,whichprovidesthatalowerforfeiturecanbeissuedwhenaggravatingfactorsarenotpresent.Furthermore,intheForfeiturePolicyStatement,theCommissionstatedthatthepurposeofupwardadjustmentfactorsistoincreasetheamountofaforfeiturefromthebaseamount. J   ׀PSEprovidesnoauthorityforthepropositionthattheabsenceofupwardadjustmentfactorsrequiresrecisionofamonetaryforfeiture.Therefore,PSE'sargumentsonthebasisofupwardadjustmentfactorsdonotwarrantrecisionoftheproposedmonetaryforfeiture...7.Similarly,PSE'sargumentthatthedownwardadjustmentfactorslistedintheForfeiturePolicyStatement"weighsheavilyinfavorofthecancellationorsubstantialreductionoftheforfeitureproposedagainstPSE"mustberejected. K   ׀ThedownwardfactorscontainedintheguidelinesallowtheCommissiontoreducepotentialforfeituresbecauseofthepresenceofcertainmitigatingevidence.Thefirstdownwardadjustmentfactorisforviolationsthatareconsideredminorinnature.PSEclaimsthatitsviolationswereminorbecauseofits"promptresponsetoitsdiscoveryoftheproblem,theunalterednatureofthelicensedoperationsandtheabsenceofharm...." L   ׀PSE'sargumentisincorrectbecausethemisconductinvolvedinthisinstanceinvolvedsubstantialnotproforma󀄄transfersofcontrol,inviolationofSection310(d)oftheAct. M   ׀Inaddition,PSE'smisconductinvolvedalargenumberofstations.Thus,thereisnobasisforconcludingthattheviolationsinthisinstancewereminor.Theseconddownwardadjustmentfactorappliesincasesinvolvingvoluntarydisclosureofmisconductbythelicenseeinquestion.WeagreewithPSEthatitmadeafullandvoluntarydisclosuretotheCommission. N   ׀Indeed,theBureauexplicitlyconsideredPSE'svoluntarydisclosureintheNALandappropriatelyreducedtheproposedforfeitureamountonthatbasis.PSEhaspresentednobasisforrescindingorfurtherreducingtheforfeitureamountbecauseofitsvoluntarydisclosure.Thethirddownwardadjustmentcriterionappliestolicenseeswithahistoryofoverallcompliance.Inthisregard,PSEclaimsgenerallytohavehad"anextendedhistoryofoverallcompliance."OurreviewofPSE'srecordasaCommissionlicenseerevealsnohistoryofpriormisconductforwhichPSEhasbeensanctioned,afactorthatwasconsideredintheNALindetermininganappropriateforfeitureamount.PSEpresentsnojustificationonthebasisofitspastrecordforrescindingorfurtherreducingtheforfeiture. T   ׀..10.WealsofindnomerittoPSE'srequestforreductionoftheforfeitureamount.PSEreliesonanumbercasesinwhichtheCommissionimposedforfeituresequaltoorlessthantheamountoftheforfeitureproposedinthiscasedespitethefactthateachoftheothercases,accordingtoPSE,involvedmoreseriousviolationsthantheinstantcase. U   ׀Whilethedurationoftheviolationsintheothercasesmayhavebeenlongerthanthatinvolvedhere,thenumberofstationsthatPSEoperatedwithoutCommissionconsentfarexceededthatinanyofthecasesonwhichPSErelies.Inthisregard,wenotethatPSE'sunauthorizedtransferofcontrolofeachstationconstitutedaseparateviolationofSection310(d)oftheAct. V   ׀ButforthemitigatingfactorsconsideredintheNAL,theforfeitureagainstPSEcouldhavebeensubstantiallyhigher...11.PSEalsoarguesthat$20,000isanexcessiveforfeitureamountbecausePSEhasalreadypaidtheCommissionafeeof$16,250forfilingarequesttowaiveSection1.924(b)oftheCommission'sRules.
