On April 25, 1994, CommNet Cellular, Inc. (CommNet) filed a petition for reconsideration of a decision by the Private Radio Bureau, Licensing Division, Microwave Branch (Branch) returning without action CommNet's notification of operation of three temporary-fixed stations under Call Sign WMI582 in the Point-to-Point Microwave Radio Service. The Branch returned the notifications because the notifications indicated that CommNet intended to seek permanent authorization to use the subject sites and frequencies. Section 21.707(a)(1) of the Commission's Rules did not permit the use of temporary-fixed authorizations to satisfy permanent requirements. On May 16, 1994, permanent authorizations for the same sites and frequencies were granted under Call Signs WMR506, WMR507, and WMR508 to Platte River Cellular of Colorado Limited Partnership, which is an affiliate of CommNet. Because the temporary authorization is no longer needed, we hereby determine that the petition for reconsideration is moot. 2. Accordingly, IT IS ORDERED that, pursuant to Section 4(i) of the Communications Act of 1934, as amended, 47 U.S.C.  154(i), and Section 1.106 of the Commission's Rules, 47 C.F.R.  1.106, the petition for reconsideration filed by CommNet IS DISMISSED WITHOUT PREJUDICE. 3.
