Before the Federal Communications Commission Washington, D.C. 20554 In re: ) ) Christel A. Anderson/CHI Trust Partnership) File No. 07613-CL-P1-95 Phase I Cellular Unserved Area ) Market 553 B3 - New Mexico 1 ) San Juan RSA ) ORDER Adopted: June 9, 1999 Released: June 9, 1999 By the Chief, Policy and Rules Branch, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. Before us is a Petition for Reconsideration (Petition) filed on April 10, 1997, by Christel A. Anderson/CHI Trust Partnership (Anderson). Anderson seeks reconsideration of the dismissal of its unserved area application by the Commercial Wireless Division's Technical Analysis Branch (the Branch). 2. On February 5, 1997, Anderson filed a Phase I cellular unserved area application to provide cellular service in Market 553B, New Mexico 1 - San Juan RSA. The Branch found that the proposed service contour in Anderson's application overlapped the Cellular Geographic Service Area (CGSA) of the New Mexico RSA-1 San Juan Limited Partnership. Accordingly, the Branch determined that Anderson's application was defective and dismissed it without prejudice. 3. Anderson presents no new facts or arguments that would lead us to change the Branch's decision. We therefore affirm our decision for the reasons stated therein. 4. Accordingly, IT IS ORDERED that pursuant to Section 4(i) of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), and Sections 0.331 and 1.106 of the Commission's rules, 47 C.F.R. 0.331 and 1.106, that the Petition for Reconsideration filed by Christel A. Anderson/CHI Trust Partnership on April 10, 1997, IS DENIED. FEDERAL COMMUNICATIONS COMMISSION Paul D'Ari Chief, Policy and Rules Branch Commercial Wireless Division Wireless Telecommunications Bureau
