This Errata corrects portions of the text and the final rules in the Report and Order and Second Notice of Proposed Rulemaking in the above-captioned proceeding, FCC 97-391, which was released November 3, 1997. These errors will be corrected prior to publication of the Report and Order and Second Notice of Proposed Rulemaking in the Federal Register and in the FCC Record. 2. The text of footnote 9 is revised to read as follows: "For both new and incumbent 39 GHz licensees, the showing required for build-out and that for obtaining a renewal expectancy are combined into one showing at the time of renewal." 3. The text of paragraphs 2 and 178 in the Report and Order and Second Notice of Proposed Rulemaking is revised to delete the reference to Part 2 of the Commission's rules, because that rule part is not being amended by the Commission's action. 4. Section 101.17(a)(2) of the rules is revised to read as follows: 101.17 Performance Requirements for the 38.6-40.0 GHz frequency band. (a) *** *** (2) A description of the 38.6-40.0 GHz band licensee's current service in terms of population served, as well as any additional service provided during the license term; *** 5. Section 101.63 of the rules is revised in paragraphs (a) and (d) by amending these paragraphs to read as follows: 101.63 Period of construction; certification of completion of construction. (a) Except for stations licensed in the 38.6-40.0 GHz band, each station licensed under this part must be in operation within 18 months from the initial date of grant. Modification of an operational station other than one licensed in the 38.6-40.0 GHz band must be completed within 18 months of the date of grant of the applicable modification request. * * * (d) Except for stations licensed in the 38.6-40.0 GHz band, requests for extension of time to be in operation may be granted upon a showing of good cause, . . .
