HIORT )File No. 26902-CD-P/ML-93 Station KNKP288 at ) Sycamore & Rochelle, Illinois ) ORDER Adopted: July 31, 1997Released: July 31, 1997 By the Chief, Commercial Wireless Division: 1. In this Order, we grant the petitions for reconsideration ("Petitions") of actions taken by the Commercial Wireless Division's Licensing and Technical Analysis Branch (formerly Narrowband Branch) on each of the above-captioned construction permits. The Licensing and Technical Analysis Branch terminated the construction permits pursuant to Section 22.144 of the Commissions rules for failure to notify the Branch of completion of modifications to the facilities. The petitioners sought reconsideration of the terminations and provided information that each had properly notified the Licensing and Technical Analysis Branch. In response to the Petitions, the Licensing and Technical Analysis Branch determined that the licensees had timely filed their FCC Form 489 notifications and reinstated the construction permits. The Petitions, however, were not formally granted. Because these Petitions technically remain pending, we formally grant the Petitions by this Order. 2. Attachment A to this Order sets forth specific information for each of the above-captioned authorizations, including: (i) the authorization file number and name of the permittee; (ii) the issuing date of the construction permit; (iii) the expiration date of the construction permit; (iv) the date on which the FCC Form 489 notification was filed; and (v) the Public Notice and date on which the licenses were reinstated. 3. Accordingly, IT IS ORDERED, that, pursuant to authority delegated by Sections 4(i) and 405 of the Communications Act, as amended, 47 U.S.C. 154(i) and 405, authority delegated by Section 0.331 of the Commission's rules, 47 C.F.R. 0.331, and pursuant to Section 1.106 of the Commission's rules, 47 C.F.R. 1.106, the Petitions for Reconsideration as set forth in Attachment A to this Order ARE GRANTED.
