Washington, D.C. 20037-1420 Re: DCR PCS, Inc., Provisional C Block Election Dear Ms. Charytan: On June 1, 1998, the Commission adopted and released a Memorandum Opinion and Order (MO&O) that granted to DCR PCS, Inc. ("DCR PCS") a provisional waiver of the June 8, 1998, C block election deadline. Under the waiver, DCR PCS was required to file, by the election deadline, a provisional election that would not be deemed effective unless and until the Commission's General Counsel specified a trigger date. On June 8, 1998, DCR PCS made its provisional election (hereinafter, "DCR PCS Election"), choosing a combination of disaggregation, prepayment and amnesty. All of the licenses that DCR PCS provisionally elected to retain would, by operation of the specifics of its election, be free and clear of any remaining debt to the Commission. Lynn R. In granting the provisional waiver, the Commission delegated to the General Counsel "the authority to designate, at his discretion but not earlier than September 30, 1998, and upon five calendar days notice to DCR PCS, a date on which the provisional election made by DCR PCS will go into effect." After a review of all the relevant facts and considerations, I am designating October 30, 1998, at 12:01 A.M., Eastern Time, the effective date of DCR PCS's Election, pursuant to the MO&O at paragraphs 7 and 13.
