Nuechterlein has been named Deputy General Counsel of the Federal Communications Commission. He will focus on litigation and, in particular, on the market- opening provisions of the Telecommunications Act of 1996. Nuechterlein comes to the FCC from the Solicitor General's office at the Department of Justice, where he briefed and argued a number of cases in the United States Supreme Court. While at Justice, he played a key role in representing the FCC in AT&T Corp. v. Iowa Utilities Board, the landmark telecommunications case in which the Supreme Court affirmed the FCC's authority to oversee implementation of the 1996 Act. This is Nuechterlein's second tour of duty at the FCC. From 1995 to 1996, he was Special Counsel to then-General Counsel William E. Kennard. Chairman Kennard said: "I'm thrilled to have Jon back at the FCC. He's a brilliant lawyer and he deserves a lot of the credit for our victory in the Interconnection case. Jon will add additional depth to our strong common carrier litigation team." From 1991 to 1992, Nuechterlein was a law clerk to Supreme Court Justice David H. Souter and, before that, to Judge Stephen F. Williams of the U.S. Court of Appeals for the D.C. Circuit. He received his law degree from Yale Law School, where he served as an Articles Editor on the Yale Law Journal, and a B.A. in Philosophy from Yale College, from which he graduated summa cum laude. - FCC -
