Washington, D.C. 20554 October 1, 1998 REFUND OF APPLICATION FEES FOR 932-932.5/941-941.5 MHz MULTIPLE ADDRESS SYSTEM APPLICATIONS On September 17, 1998, the Public Safety and Private Wireless Division (Division) of the Wireless Telecommunications Bureau dismissed all the pending Multiple Address System (MAS) applications for use of the 932-932.5/941-941.5 MHz bands. Prior to and subsequent to the Division's action, we have received inquiries regarding the refund of filing fees for MAS applicants for the 932-932.5/941- 941.5 MHz frequencies. Section 1.1113(a)(4) of the Commission's rules, which governs the refund of filing fees, provides that the full amount of any fee submitted will be returned or refunded, as appropriate, when the Commission adopts new rules that nullify applications already accepted for filing, or a new law or treaty would render useless a grant or other positive disposition of the application. See 47 C.F.R.  1.1113(a)(4). As indicated in the Division's order, the Balanced Budget Act of 1997, Pub. Law No. 105-33, Title III, 111 Statute 251 (1997), terminated the Commission's statutory authority to use lotteries to grant licenses. Because the Commission was without authority to process the MAS applications pursuant to the rules under which they were filed (i.e., lotteries) the Division dismissed the pending subject MAS applications. As a result, the MAS applicants for the 932-932.5/941/941.5 MHz frequencies are entitled to a refund. In order to expedite processing of the application fee refunds to the MAS applicants for the 932- 932.5/941-941.5 MHZ frequencies and to ensure that we have the most current address, each applicant is responsible for providing the FCC a current address to which the refund is to be mailed. If that is unacceptable, proper justification must be provided. If available, applicants may wish to include proof of payment in order to further expedite the refund. Any applicants wishing to have their refund sent to them by electronic fund transfer, should provide Automated Clearing House (ACH) information in the letter. This information should include: Payor Name; Applicant Name; Payor Taxpayer Identification Number; Bank Name; Name of Bank Account (if different); ABA Routing Transit Number; Bank Account Number; Bank Account Type (Savings/Checking); Amount of Refund; Bank Contact Person & Telephone No; and Bank Address. In the alternative, a check made payable to the original maker will be issued.
