Washington, D.C. 20554 October 30, 1997 C OMMISSION CLARIFIES USE OF FCC FORM 159/159-C, REMITTANCE ADVICE & REMITTANCE ADVICE CONTINUATION SHEET On August 13, 1997, the Commission issued a Public Notice announcing the revised FCC Form 159/159-C dated July 1997. This form was revised primarily to provide the applicant's/filer's Taxpayer Identification Number (TIN) as mandated by the Debt Collection Improvement Act of 1996. The Taxpayer Identification Number (TIN) may be either your Employer Identification Number (EIN) if you are a business entity, or your Social Security Number (SSN) if you are an individual applicant. All applicants/filers, excluding entities not required to have a TIN, must provide the applicable EIN or SSN as mandated by the Act. The revised FCC Form 159/159-C must be submitted with any application or filing (regardless of service or Bureau/Office) with the Federal Communications Commission subject to a fee, and with the payment of Section 9 annual regulatory fees. Only the payers of Section 9 regulatory fee filings, or their legal representatives, are required to sign the certification statement on the revised FCC Form 159 attesting to accuracy of the data submitted. Effective December 15, 1997, the revised FCC Form 159/159-C (dated July 1997) must be submitted with any application or filing subject to a fee received at the Commission. If the application you are currently using has the fee information as part of the front page of the application, you are also required to file the revised Form 159. To eliminate the burden of having to provide the same information on both the application and the Form 159, you do not have to report the payment type code, quantity, and fee due on the application, but you must report it on the completed Form 159. As application forms are revised, this portion of the application will be removed. The revised Form 159 will be separated from the application/filing after it has been processed by the lockbox bank, and kept in the Financial Operations Division, Billings & Collection Branch. Failure to use the revised FCC Form 159/159-C dated July 1997, beginning December 15, 1997, may result in a delay in processing your application refund request, and may also result in the possible return of your application for additional information.
