On June 16, 1997, the Commission adopted a Report and Order establishing its regulatory fees, promulgated pursuant to Section 9 of the Communications Act, for Fiscal Year (FY) 1997. See 47 U.S.C. 159; see also Assessment and Collection of Regulatory Fees for Fiscal Year 1997 in MD Docket No. 96-186, FCC 97-215 (62 FR 37422, July 11, 1997). Therein, the Commission, among other things, modified Section 1.1152 of the Rules, to adjust the amount of regulatory fees payable by licensees in the Wireless Services. 47 C.F.R. 1.1152. 2. Through administrative oversight, when Section 1.1152 was amended to reflect the adjusted 1997 regulatory fees, corresponding provisions of Section 1.1102 were not updated to reflect the combined amount of the filing fee required by Section 8 of the Act and the FY 1997 regulatory fee payable by applicants in those Wireless Services where both a filing fee and a regulatory fee is required with an application for a new or renewal license. 3. The attached revised Schedule of Charges for applications and other filings in the Wireless Telecommunication Services, 47 CFR, Part 1, update Section 1.1102 to include the FY 1997 adjustments to the regulatory fees applicable to the specified Wireless Telecommunications Services, discussed above. Because the revisions in the attached Schedule merely update Section 1.1102, prior notice and comment are not required. FEDERAL COMMUNICATIONS COMMISSION Andrew S. Fishel Managing Director Attachment
