The Allocations Branch has before it a Notice of Proposed Rule Making, 14 FCC Rcd 9543 (1999), issued at the request of M. Kent Frandsen ("petitioner"), permittee of Station KNYN(FM), Channel 256C3, Fort Bridger, Wyoming, proposing the downgrade from Channel 256C1 to Channel 256C3 at Fort Bridger, the reallotment of Channel 256C3 from Fort Bridger to Hyrum, Utah, and the modification of Station KNYN(FM)'s construction permit accordingly. Petitioner filed comments in support of the proposal reaffirming his intention to apply for the channel, if reallotted to Hyrum, Utah. Comments were also filed by KGNT, Inc., licensee of Station KGNT(FM), Channel 280A, Smithfield, Utah. Petitioner and KGNT, Inc. filed reply comments. Petitioner filed a response to reply comments. KGNT, Inc. filed a motion to strike and petitioner filed an opposition to motion to strike. KGNT, Inc. filed a reply to the opposition to motion to strike. On June 16, 2000, petitioner filed a request for dismissal and a new petition for rule making proposing the reallotment of Channel 256C1 from Fort Bridger, Wyoming to Woodruff, Utah. Therefore, we will grant petitioner's request to dismiss the instant proposal. 2. Accordingly, IT IS ORDERED, That the petition for rule making filed on July 8, 1998 by M.
