The Commission has before it the Petition for Reconsideration filed by Luella Hoskins ("petitioner"), of the Report and Order, 14 FCC Rcd 11791 (1999), which dismissed her petition for rule making to allot Channel 241C3 to Stanfield, Oregon, because of a lack of interest in filing an application for the proposed allotment. 2. In her petition for reconsideration, petitioner states that she was never served with a copy of the Notice of Proposed Rule Making and thus had no knowledge that comments were due. However, she states that she intends to apply for the channel, if allotted. 3. We believe the public interest would be served by allotting Channel 241C3 to Stanfield, Oregon, since it could provide the community with its first local aural service. Inasmuch as the channel would have been allotted in the Report and Order had it not been for the lack of an expression of interest, we believe that revising the earlier decision is warranted. Since this proceeding is uncontested, we believe that expending the Commission's administrative resources to issue a new Notice of Proposed Rule Making would delay service to Stanfield and not serve the public interest. Channel 241C3 can be allotted to Stanfield in compliance with the Commission's minimum distance separation requirements with a site restriction of 17.3 kilometers (10.7 miles) southwest to avoid a short-spacing to Station KNLT, Channel 239C, Walla Walla, Washington, and to Station KRCW, Channel 242C2, Royal City, Washington. 4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective March 17, 2000, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Stanfield, Oregon 241C3 5. A filing window for Channel 241C3 at Stanfield, Oregon, will not be opened at this time. Instead, the issue of opening a filing window for this channel will be addressed by the Commission in a subsequent order. 6. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 7.
