                                   ORDER

  By the Commission:

     1.  In Lutheran Church - Missouri Synod v. FCC, 141 F.3d 344 (D.C. Cir. 1998), petition for
reh'g denied, 154 F.3d 487, petition for reh'g en banc denied, 154 F.3d 494 (D.C. Cir. 1998)("Lutheran
Church"), the Court of Appeals for the District of Columbia Circuit held that the EEO program
requirements set forth in Section 73.2080 of the Commission's Rules, 47 C.F.R. Section 73.2080, are
unconstitutional under the Equal Protection Clause of the Fifth Amendment.  All of the above-captioned
orders imposed forfeitures based solely on violations of the EEO program requirements that were
invalidated in Lutheran Church.  Accordingly, the Commission will not seek to enforce these orders.

     2.  ACCORDINGLY, IT IS ORDERED that the above-captioned forfeiture orders ARE
VACATED.
