In Greater New Orleans Broadcasting Ass'n v. United States, 119 S.Ct. 1923 (1999), the Supreme Court held that Section 1304 violates the First Amendment as applied to truthful advertisements for lawful casino gambling that are broadcast in States that permit such gambling. All of the above-referenced decisions impose forfeitures for the broadcast of truthful advertisements for lawful casino gambling by stations located in States that permit such gambling. Accordingly, the Commission will not seek to enforce these decisions. 2. ACCORDINGLY, IT IS ORDERED that the above-referenced Notices of Apparent Liability ("NALs") issued against KLAS, Inc., DR Partners, WTMJ, Inc., and Valley Broadcasting Company are hereby RESCINDED and the pending responses to such NALs are DISMISSED AS MOOT. 3. IT IS FURTHER ORDERED that the above-referenced forfeiture orders issued against Hualapai Broadcasters, Inc., Channel 33, Inc., Commonwealth Broadcasting of Northern California, and Fernal, Inc. are hereby VACATED.
