The Commission has before it for consideration a multiple docket Notice of Proposed Rule Making ("NPRM"), as specified below, setting forth separate proposals to allot channels to specific communities. The proposals set forth in the above-captioned NPRM were not mutually exclusive with each other, and those that remain so are consolidated in this Report and Order as part of our effort to expedite and make more efficient the FM allotment rulemaking process because these proceedings are uncontested. While consolidated, these dockets are still separate for finality purposes. In the event a reconsideration petition is directed to an action in a particular docket, a separate Memorandum Opinion and Order will resolve that reconsideration petition. 2. Each petitioner filed comments in support of its proposal, reaffirming its intention to apply for the specified channel, if allotted. Each proposal complies with all Commission technical requirements, and we continue to believe that each proposal would serve the public interest. Accordingly, we adopt each proposal as follows: (1) MM Docket No. 99-182; RM-9585; (DA 99-971) released May 21, 1999 Action: At the request of Mountain West Broadcasting, we are allotting Channel 269A to Hamilton City, California, as that community's first local aural transmission service. Coordinates: 39-49-52 NL and 122-02-31 WL Additional Information: Channel 269A can be allotted to Hamilton City with a site restriction. 10.1 kilometers (6.3 miles) north of the community to avoid a short spacing to Station KMJE(FM), Channel 268A, Gridley, California, at coordinates 39-12-21 NL and 121-49-11 WL. (2) MM Docket No. 99-184; RM-9587; (DA 99-971) released May 21, 1999 Action: Mountain West Broadcasting requested the allotment of Channel 289A to Lost Hills, California, as that community's first local aural transmission service. Petitioner and Lost Hills Broadcasting Company each filed supporting comments. In view of the interests expressed in providing a first local aural transmission service to Lost Hills, California, we are allotting Channel 289A to that community, as requested. Coordinates: 35-38-19 NL and 119-48-26 WL Additional Information: Channel 289A can be allotted to Lost Hills with a site restriction. 11 kilometers (6.9 miles) west to avoid a short spacing to Station KKDJ(FM), Channel 287B, Delano, California, at coordinates 35-30-53 NL and 119-03-41 WL. Coordinates: 35-05-01 NL and 119-26-00 WL Additional Information: Channel 235A can be allotted to Maricopa with a site restriction 3.7 kilometers (2.3 miles) northwest of the community to avoid a short spacing to Station KBBY-FM, Channel 236B, Ventura, California, at coordinates 34-06-47 NL and 119-03-34 WL. (4) MM Docket No. 99-189; RM-9592; (DA 99-971) released May 21, 1999 Action: At the request of Mountain West Broadcasting, we are allotting Channel 289C2 to Golden Meadow, Louisiana, as that community's first local FM transmission service. Coordinates: 29-14-00 NL and 90-15-00 WL Additional Information: Channel 289C2 can be allotted to Golden Meadow with a site restriction 17.6 kilometers (11 miles) south of the community to avoid short spacings to Station WLTS-FM, Channel 287C1, Kenner, Louisiana, at coordinates 29-58-57 NL and 87-57-09 WL; Station WAKH(FM), Channel 289C1, McComb, Mississippi, at coordinates 31-15-31 NL and 90-14-03 WL (construction permit) and at coordinates 31-16-50 NL and 90-27-05 WL (licensed site); as well as to Station KHOM(FM), Channel 290A, Berwick, Louisiana, at coordinates 29-45-27 NL and 91-10-25 WL. Accordingly, pursuant to the authority found in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective October 18, 1999, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED, with respect to the communities listed below, to read as follows: Community Channel No. Hamilton City, California 269A Lost Hills, California 289A Maricopa, California 235A Golden Meadow, Louisiana 289C2 4. The window period for filing applications for these allotments will not be opened at this time. Instead, the issue of opening a filing window for these allotments will be addressed by the Commission in a subsequent order. 5.
