At the request of STARadio Corporation ("petitioner"), the Commission has before it the Notice of Proposed Rule Making, 13 FCC Rcd 9528 (1998), proposing the allotment of Channel 293A to St. Anne, Illinois, as the community's first local aural transmission service. Petitioner filed comments in support of the proposal reaffirming its intention to apply for the channel, if allotted. Milner Broadcasting Company ("Milner") also filed supporting comments stating its intention to apply for the channel. 2. As stated in the Notice, St. Anne is an incorporated community with a 1990 U.S. Census population of 1,153 persons. The community has its own local government, a post office, a school, and businesses. 3. We believe the publici interest would be served by allotting Channel 293A at St. Anne, Illinois, since it would provide the community with its first local aural transmission service. An engineering analysis has determined that Channel 293A can be allotted to St. Anne in compliance with the Commission's minimum distance separation requirements with a site restriction of 10.6 kilometers (6.6 miles) southeast to avoid short-spacings to the licensed sites of Station WYBA(FM), Channel 292A, Lansing, Illinois, and Station WGCY(FM), Channel 292A, Gibson City, Illinois. 4. Accordingly, pursuant to the authority found in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective, September 27, 1999, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. St. Anne, Illinois 293A 5. A filing window for Channel 293A at St. Anne, Illinois, will not be opened at this time. Instead, the issue of opening a filing window for this channel will be addressed by the Commission in a subsequent order. 6. IT IS FURTHER ORDERED, That the petition for rule making filed by Milner Broadcasting Company, requesting the allotment of Channel 293A at Beaverville, Illinois (RM-9358), IS DISMISSED. 7.
