In response to a petition filed by Results Broadcasting of Iron Mountain, Inc. ("RBI"), the Commission has before it for consideration the Notice of Proposed Rule Making, 13 FCC Rcd 13337 (1998), seeking the allotment of Channel 262A at Powers, Michigan, as that community's first local service. RBI filed supporting comments in which it reaffirmed its interest in Channel 262A. Crystal Radio Company ("Crystal") filed comments. On September 8, 1998, RBI withdrew its interest in the allotment of an FM channel at Powers, Michigan. No other comments or expressions of interest were received at the Commission for an allotment at Powers. 2. Crystal filed comments requesting the allotment of Channel 297A to Powers in lieu of Channel 262A. Crystal points out that allotment of the alternate channel at Powers would allow the Commission to grant Crystal's application to modify the facilities for Station WOBE, Crystal Falls, Michigan, of which it is the permittee. Crystal indicates that it intends to relocate the WOBE transmitter to a site which would allow the station to provide greater coverage to the community. According to Crystal, the proposal for Powers is mutually exclusive with its application for Crystal. Crystal supports an allotment at Powers which would allow for the grant of its application for Station WOBE at Crystal Falls. 3. As stated in the appendix to the Notice, a showing of continuing interest is required before a channel will be allotted. It is the Commission's general policy to refrain from making a new allotment to a community absent an expression of interest. Therefore, since there has been no such interest here, we will dismiss RBI's proposal. 4. Accordingly, IT IS ORDERED, That the petition of Results Broadcasting of Iron Mountain, Inc., requesting the allotment of Channel 262A at Powers, Michigan, IS HEREBY DISMISSED. 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6. For further information concerning this proceeding, contact Kathleen Scheuerle, Mass Media Bureau, (202) 418-2180.
