At the request of Live Oak Broadcasting ("petitioner"), the Commission has before it the Notice of Proposed Rule Making, 13 FCC Rcd 2607 (1998), proposing the allotment of Channel 265A to Three Rivers, Texas, as the community's second local FM service. No comments were received from the petitioner or any other party stating an intention to file an application for Channel 265A at Three Rivers. 2. As stated in the Notice, a showing of continuing interest is required before a channel will be allotted, and absent such an expression of interest, it is Commission policy to refrain from allotting a channel. See e.g., Joshua Tree, California, 4 FCC Rcd 3801 (1989); Bridport, Vermont, 5 FCC Rcd 6172 (1990); and paragraph 2 of the Appendix to the Notice. Therefore, petitioner's request to allot Channel 265A to Three Rivers, Texas, will be dismissed. 3. Accordingly, IT IS ORDERED, That the request of Live Oak Broadcasting to allot Channel 265A to Three Rivers, Texas, IS DISMISSED. 4. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 5.
