To accommodate Channel  x<228C2 at Three Rivers, Reina Broadcasting proposes the substitution of Channel 264A for vacant  X-Channel 228A at Carrizo Springs, Texas.X yO- xԍAs a result of our action in this proceeding, we will have considered a Reina Broadcasting proposal for a  xChannel 234C2 upgrade at Corpus Christi and channel substitutions at Carrizo Springs and Three Rivers in the  xKcontext of two separate dockets. As stated earlier, the Reina Broadcasting alternative resolution in MM Docket  xNo.91193 was an untimely counterproposal and therefore not accepted into that proceeding. The record in that  x;proceeding closed and was resolved without any comparative evaluation given to the Reina Broadcasting alternative  xproposal. In the context of this proceeding, there is no rule or policy which would prohibit its consideration. This  xis not a contingent counterproposal because we can consider the Reina Broadcasting counterproposal regardless of  xany action in MM Docket No. 91193. It is also our view that consideration of this counterproposal is the procedure  xmost conducive to the efficient transaction of Commission business. Public Notice of Reina Broadcasting's counterproposal was given March 4, 1996, Report No. 2123.   0x4. After careful consideration of the two competing proposals, we are allotting Channel" ,-(-(ZZ"  X- xN228C3 to George West, Texas, as a second local service.OX yOy- x,ԍThe reference coordinates for Channel 228C3 at George West, Texas, are 281546 and 981224. This site is  xK12 kilometers (7.5 miles) southwest of George West. Mexican concurrence has been obtained for this allotment pursuant to the U. S. Mexico FM Agreement. O There are two reasons for this  X- xdecision. First, this action is consistent with our FM allotment priorities set forth in Revision of  X- xFM Assignment Policies and Procedures, 90 FCC 2d 88(1982).  yOk- xԍThe allotment priorities are: (1) First full-time aural service; (2) Second full-time aural service; (3) First local service; and (4) Other public interest matters. Coequal weight is given to Priorities (2) and (3).  Under Priority (4), we believe  x^that a new Channel 228C3 allotment at George West would be preferable to the Reina  X- xBroadcasting proposal for a Channel 234C2 upgrade for its Station KBSO in Corpus Christi.Dx@ yO - xԍAt the time Reina Broadcasting filed its counterproposal, Station KBSO was operating as a Class A facility.  xIn its counterproposal, Reina Broadcasting refers to its Hispanic ownership and programming and the fact that  xupgrading Station KBSO would eliminate a shortfall in principal city coverage of Corpus Christi. In addition to the  xfact that ownership and programming issues are not taken into consideration in an allotment proceeding, all of these  xconcerns are premised upon the former Class A status of Station KBSO. As noted earlier, Station KBSO is now  xlicensed as a Class C3 facility which ameliorates the concerns expressed by Reina Broadcasting in its counterproposal. D  X- xSee Benton, Arkansas, et. al, 2 FCC Rcd 1963 (1987). Second, to accommodate this single  xupgrade, Reina Broadcasting proposes channel substitutions at four communities including George  xWest, Texas. As stated earlier, Reina Broadcasting proposes the substitution of Channel 281C3  x\for Channel 281A at George West. However, there is a pending application for the Channel  X1- x281A allotment at George West.W1  yOb-ԍFour M.L.Broadcasting (File No. BPH940207MA).W An upgraded allotment requires a new filing window. We will  xnot upgrade an allotment and open a new filing window without the express agreement of the  X - xapplicant. See Lafayette, Louisiana, 2 FCC Rcd 7303 (1987). In the absence of such an  x[agreement, we will not substitute Channel 281C3 in order to accommodate a proposed upgrade at Corpus Christi.   x5.
