(ii) the licensee's responses to staff inquiries; and (iii) various  SN-other pleadings.  S- II. BACKGROUND ă  S- ` Ԋx2.` ` We have reviewed the licensee's renewal applications, annual employment reportsand  S- x@inquiry responses.VX, yO~"-  #X\  P6G;qP#эxThe licensee, in its second inquiry response, corrects several errors that it made in its first inquiry  xwresponse. These errors include failing to list a hire occurring during the three year period under review, indicating  xthat recruitment sources had been contacted for one vacancy when they had not, and failing to provide complete  xapplicant information for one vacancy. In addition, at the time of each of its two inquiry responses, the license  xwfiled an amendment to its Broadcast Equal Employment Opportunity Program Report (Form 396). According to the  x=licensee, the amendments were necessary due to several errors in its original Form 396, which cumulatively  yO.'- xincluded underestimating the number of hires occurring during the renewal year, i.e, the 12month period prior  xto filing Form 396, by 6 parttime hires overall and upperlevel and one upperlevel fulltime hire, and  xoverestimating the number of minority and female referrals received from recruitment sources during that period  yO)-by one minority referral and eight female referrals.V Initially, we note that the information that we reviewed included data for  xWFNT(AM)/WCRZ(FM) and WWBN(FM), Tuscola, Michigan. The licensee took control of  xWWBN(FM) on August 31, 1994. WWBN(FM)'s renewal application (BRH960502YC) wasX6  ,,, 3a'#~RaddX  S- xinadvertently granted on September 27, 1996. yOh-  M#X\  P6G;qP#эxWWBN(FM)'s renewal application indicated that it employed fewer than five fulltime employees and did not reveal that it is operated jointly with WFNT(AM)/WCRZ(FM). Nonetheless, we will consider all information supplied by  xthe licensee for all three stations as relevant to the issue of compliance with our Equal Employment  xOpportunity (EEO) Rule regarding the renewal of licenses for WFNT(AM)/WCRZ(FM). We believe that  xthis course is appropriate because, according to the licensee, the stations are commonly owned and  xKoperated, and WFNT(AM)/WCRZ(FM)'s Forms 395B (Broadcast Annual Employment Reports) and 396  x(Broadcast EEO Program Report) contain information concerning all three stations. Consequently, we  xkconclude that the three stations share the same EEO program. "[O]ur analysis and ruling relate to the  S-adequacy of a licensee's EEO program and not the number of stations subject to that program."  yO -#X\  P6G;qP#эxRadio Dinuba Company, 11 FCC Rcd 8931, 8936 (1996).  S- III. DISCUSSION ă  SH - ` x3.` ` Section 73.2080 of the Commission's Rules requires that a broadcast licensee refrain from  xNemployment discrimination and establish and maintain an EEO program that reflects positive and  x!continuing efforts to recruit and promote qualified women and minorities. When evaluating EEO  xperformance, the Commission focuses on the licensee's efforts to recruit and promote qualified minorities  xkand women and the licensee's ongoing assessment of its EEO efforts. Such an assessment enables the  xlicensee to take corrective action if qualified women and minorities are not present in the applicant and  SX- xinterview pools. The Commission also focuses on any evidence of discrimination by the licensee. See  S0-Sections 73.2080 (a), (b), and (c) of the Commission's Rules, 47 C.F.R.  73.2080 (a), (b), and (c).  S-  S- ` x4.` ` Review of the licensee's renewal applications and inquiry responses reveals that the  S- xlicensee had 25 fulltime hires, 21 for upperlevel positions, from October 1, 1993, to October 1, 1996.z  yO-  #X\  P6G;qP#эxWe also note that the licensee considers the hiring of an intern for a fulltime position to be a promotion  xand not a hire. As reflected in case precedent, we consider such an action to be a hire and have considered it as  yO- xone of the 25 hires occurring during the review period. See e.g., Applicants of Certain Broadcast Stations Serving  yO`-Communities in Sarasota, Florida and Other Florida Communities, 5 FCC Rcd 5683, 5688 n.4 (1990).z  xIn its inquiry response, the licensee indicates that it did not actively recruit for ten vacancies. There were  x[no minority applicants for those ten vacancies and nine of the ten vacancies had only one applicant. For  x four additional vacancies, the licensee states that it could not contact outside recruitment sources for  xvarious reasons, including preventing its competition from knowing about an upcoming change in a  xstation's format and preventing an incumbent employee from knowing that the licensee was seeking his  xLreplacement. Therefore, for those vacancies, the licensee reviewed ads placed by prospective applicants  xin the Michigan Association of Broadcasters Job Bank postings. Although this source did not refer any  xminority applicants for these positions, it did refer two Black applicants, one of whom was hired, for  xanother fulltime position during the period under review. For the remaining 11 vacancies the licensee  xcontacted at least 28 recruitment sources, including one female and eight minority sources. The licensee  xrecruited for only three (27.3%) of its last 11 fulltime vacancies occurring during the period under review, specifically vacancies occurring from July 13, 1995, until October 1, 1996, the end of the license term.  S- ` x5.` ` The stations had 22 applicant and interview pools (18 upperlevel) because in three  xinstances the same pool was used twice. The licensee reports that it attracted 215 applicants (136 for"`,"("("  S- xLupperlevel positions), including 31 minorities (18 for upperlevel positions). yOh-#X\  P6G;qP#эxThe licensee did not know the race or ethnic origin of 33 applicants for one lowerlevel position. The licensee reports that  xkit attracted 91 interviewees (67 for upperlevel positions), including 17 minorities (11 for upperlevel  x[positions). Minorities were present in nine (40.9%) of the licensee's 22 applicant pools, including seven  x(38.9%) of the licensee's 18 upperlevel applicant pools. Minorities were present in eight (36.4%) of the  x[licensee's 22 interview pools, including six (33.3%) of the licensee's 18 upperlevel interview pools. The  xlicensee reports that, during the period under review, it hired three Blacks and two Hispanics, including  S- xytwo Blacks and one Hispanic for upperlevel positions. X yO -  #c PE37P# čxAccording to 1980 Census data, the Flint, Michigan Metropolitan Statistical Area (MSA), had a 40.6%  xJfemale and 17.3% minority labor force (15.0% Black, 1.3% Hispanic, and 1.0% Other). The stations' 1990 Annual  xEmployment Report lists 16 females (50.0%) and two minorities [one Black (3.1%) and one Hispanic (3.1%)] on  xZan overall staff of 32, and 13 females (44.8%) and one Black (3.4%) on an upperlevel staff of 29. In 1991 and  x1992, the stations employed 15 females (46.9%) and two minorities [one Black (3.1%) and one Hispanic (3.1%)]  x,on an overall staff of 32 and 12 females (41.4%) and one Black (3.4%) on an upperlevel staff of 29. The licensee states that it began providing time brokerage services to WWBN(FM), Tuscola, Michigan, on October 27, 1991.  xThe Commission uses 1990 labor force statistics for license renewal applications filed after May 31, 1993, and for  yO- x1993 Annual Employment Reports. See Public Notice # 32651 (April 12, 1993). According to 1990 Census data,  xthe Flint, Michigan MSA labor force includes 45.3% females and 18.8% minorities (15.9% Black, 1.7% Hispanic,  xand 1.2% Other). The stations' 1993 Report lists 13 females (43.3%) and one Hispanic (3.3%) on an overall staff  xof 30 and ten females (37.0%) and no minorities on an upperlevel staff of 27. The stations' 1994 Report lists 13  xfemales (41.9%) and one Hispanic (3.2%) on an overall staff of 31 and ten females (35.7%) and no minorities on  xan upperlevel staff of 28. The licensee took control of Station WWBN(FM) on August 31, 1994, and currently  xYoperates the station jointly with WFNT(AM)/WCRZ(FM). The stations' 1995 Report lists 14 females (51.9%) and  xtwo minorities [one Black (3.7%) and one Hispanic(3.7%)] on an overall staff of 27 and ten females (43.5%) and  xYno minorities on an upperlevel staff of 23. The stations' 1996 Report lists 16 females (48.5%) and four minorities  x[two Blacks (6.1%) and two Hispanics (6.1%)] on an overall staff of 33 and 12 females (41.4%) and three minorities [two Blacks (6.9%) and one Hispanic (3.4%)] on an upperlevel staff of 29. In addition, the licensee states that it offered an upperlevel position to a Black female, who declined the position.  S- ` x6.` ` In its Form 396, the licensee states that it continually reassesses the stations' EEO program,  xmaintains written and oral contact with a broad group of minority and female sources, keeps extensive  x[records of EEO activities and has adopted a comprehensive quarterly EEO review. It further states that,  xzalthough its minority recruitment sources have not been as productive as it would like, it continues to  x/contact those sources in anticipation of an improved response while also actively searching for other  xrecruitment sources for minority and female applicants. In its inquiry responses, the licensee describes its  xMquarterly review in detail by stating that "[o]n a quarterly basis, the licensee completes special forms  xLsummarizing their Staff Profile, Hiring Activity, Referral Source Summary, Hiring Pool Summary, which  x-it then sends to communications counsel for review." The licensee further states that the stations' incentive  xlto increase minority employment remains, as their staff profiles have not been reflecting the racial  xcomposition of the general labor force. The result of the efforts the licensee have made, however, is  xshown...through the fact that the rate of hiring minority employees during the past three years exceeds  xzparity." Referring to some of these vacancies in its first inquiry response, the licensee states that "no  x=recruitment occurred when a good on air personality became available, a highly respected sales person in  xthe market let it be known she was interested in working for the stations, or a good candidate identified  x=in prior recruitment reapplied. The number of such cases was limited in number and did not exceed one"@,"("(6"ԫ xthird of the fulltime openings filled." In its second inquiry response, the licensee repeated the first  xsentence of the quote but changed the last sentence to read "[t]o recruit in such situations would have been  xunnecessarily formulaic." In a supplement to its inquiry response, the licensee asserts that its "recruitment  xefforts, formal or informal, were implemented for a full two thirds (66.67%) of the attributable job  S`-openings." (footnote omitted).( ` yO-  #X\  P6G;qP#эxThe licensee's 66.67% estimate of its recruitment efforts includes two hires for which the licensee did not  xformally recruit but for which the applicants hired "came from referral pools involving positions that were  xpreviously recruited formally for by [the licensee]." However, one of these positions contained only one applicant  xin the applicant and interview pool and made no reference to the vacancy for which the applicant originally applied  xor when it occurred. In addition, concerning the second position, there was only one applicant and interviewee;  xshe applied for a position in December 1995; the position was filled January 8, 1996, by another applicant but the  x;licensee identified the subject applicant at the time she applied "as a potential future candidate;" she reapplied  yO@ - x,in the second quarter of 1996 and was hired in June 1996. Under the circumstances described supra, we conclude  xthat the licensee made inadequate recruitment efforts for these two positions. The licensee has not given us any  xbasis upon which to assess whether the applicant for the first vacancy was the result of adequate recruitment  xand/or came from a diverse pool. Apparently, although the applicant for the second position had applied to the  xstation before, her second application was unsolicited. In both cases, there was no evidence of a diverse pool of applicants, as there was only one applicant for both vacancies.  S- ` x7.` ` Our review of the stations' record reveals no evidence that the licensee engaged in  xemployment discrimination. We conclude that grant of the renewal applications for Stations  xWFNT(AM)/WCRZ(FM) would be consistent with Section 309(k) of the Communications Act of 1934,  xas amended, 47 U.S.C.  309(k). The licensee recruited for, attracted, interviewed, and hired minorities  x[during the review period. Thus, because the licensee is otherwise qualified, grant of the applications will serve the public interest. 47 U.S.C.  309(d)(2).  S - ` x8.` ` Nevertheless, we find WFNT(AM)/WCRZ(FM)'s overall recruitment efforts to be deficient  xbecause the licensee failed to recruit actively for 10 (40.0%) of its 25 vacancies, and, despite having  xLminority applicants in only nine (40.9%) of 22 applicant pools and eight (36.4%) of 22 interview pools,  xfailed to engage in meaningful selfassessment of its EEO program by making significant changes to  ximprove its recruitment efforts. 47 C.F.R.  73.2080. In fact, it appears from the record that the licensee's  xrecruitment efforts decreased sharply at the end of the license term, as evidenced by the fact that it  xrecruited for only three (27.3%) of 11 vacancies during the last fourteen months of the term. From  S- x=statements made by the licensee, discussed supra, it appears that the licensee believed that recruiting for  xapproximately twothirds of its vacancies during the period under review constituted adequate EEO efforts  x.and that requiring recruitment for every vacancy would be "unnecessarily formulaic." However, Section  xz73.2080(c)(2) of the Commission's Rules requires licensees to contact potential sources of female and  xminority applicants when vacancies occur. 47 C.F.R.  73.2080(c)(2). "While we anticipate that licensees  xwill report occasional, unexpected vacancies for which no recruitment occurred, we expect broadcasters  S- x.to engage in consistent recruitment efforts." Applications of Enterprise Media of Toledo, L.P., 12 FCC  S- xRcd 3920 (1997) (Toledo). The licensee states that it continually reassesses its EEO program and  xconducts a quarterly EEO review. Nevertheless, it failed to ensure that outside recruitment sources were  xcontacted when vacancies occurred, despite the fact that there were no minorities in the ten applicant pools  x.for which it failed to actively recruit. We believe that the record in this case is evidence that the licensee  xengaged in inadequate recruitment efforts and poor selfassessment of its EEO program, in violation of the EEO Rule, 47 C.F.R. " ,"("(/"Ԍ 73.2080.  S- ` Bx9.` ` After carefully reviewing the facts, we find that the record in the instant case is similar  S- xZto, but less egregious than, that of KXRMTV, Colorado Springs, Colorado in KXRM Partnership, 11 FCC  S`- xRcd 17098 (1996). ` yO-  #X\  P6G;qP#эxStation KXRMTV is located in the Colorado Springs, Colorado MSA labor force which included 45.3% females and 13.4% minorities (4.1% Black, 7.3% Hispanic, and 2.0% other). KXRMTV failed to recruit for 16 (57.1%) of its 28 vacancies and included minority  xapplicants in only ten (35.7%) of it 28 overall interview pools and eight (40.0%) of its 20 upperlevel  x=interview pools. In addition, the licensee failed to maintain complete applicant data. We concluded that  xthe record in that case indicated that the licensee's recruitment efforts were deficient and that it failed to  xlmaintain adequate records for meaningful selfassessment. 47 C.F.R.  73.2080. Accordingly, we  xrenewed the license of KXRMTV subject to reporting conditions and issued a Notice of Apparent Liability for $13,000.  S - ` x 10.` ` WFNT(AM)/WCRZ(FM) and KXRMTV both engaged in inconsistent recruitment efforts  xand failed to selfassess adequately. WFNT(AM)/WCRZ(FM) and KXRMTV were located in areas with  xsignificant minority labor forces, 17.3% in 1980 and 18.8% in 1990, and 13.4%, respectively; had a  xjsignificant number of hiring opportunities, 25 and 28, respectively; and yet had minorities in only 36.4%  xand 35.7% of their interview pools, respectively. The licensee of KXRMTV failed to keep complete  xapplicant records, necessary for meaningful selfassessment, whereas the licensee in this case kept almost  S0- xNcomplete records of its EEO efforts. However, as discussed supra, it appears that the licensee of  xWFNT(AM)/WCRZ(FM) did not meaningfully selfassess the information that it maintained as evidenced  xjby its failure to ensure that outside recruitment sources were contacted when vacancies occurred, despite  xhaving no minorities in the ten applicant pools for which it failed to actively recruit. Moreover, it appears  xthat WFNT(AM)/WCRZ(FM)'s EEO efforts significantly decreased at the end of the license term, as  xshown by the stations' failure to recruit for eight of 11 vacancies occurring during the last fourteen months  xof the license term. KXRMTV's record is more egregious than that of WFNT(AM)/WCRZ(FM) because  xthe former failed to recruit for a larger overall percentage of vacancies than the latter, 57.1% and 40.0%,  xrespectively. Given the facts of this case and broadcasters' familiarity with our longstanding EEO rule,  xwe conclude that a Notice of Apparent Liability for $11,000 is justified. Further, we impose reporting  xconditions to monitor the licensee's prospective recruitment and recordkeeping measures. Accordingly,  xfinding the licensee to be otherwise qualified, we will grant renewal subject to reporting conditions, and  xissue a Notice of Apparent Liability for $11,000. In addition, we admonish the licensee for initially filing  S(- x=incorrect information with the Commission in its Form 396 and in its first inquiry response. See note 2,  S-supra. We expect licensees to exercise greater care in their submissions to the Commission.  S- IV.
