However, the data  xfor the remaining 198 applicants indicate that the licensee attracted 83 minority applicants overall (8.4%)  xKand 69 minority applicants for upperlevel positions (8.0%). The station's 1992 Annual Employment  x;Report lists 71 females (37.4%), 19 Blacks (10.0%), seven Hispanics (3.7%), and one Asian/Pacific Islander (0.5%)  xon an overall staff of 190, including 50 females (30.3%), 15 Blacks (9.1%), six Hispanics (3.6%), and one Asian/Pacific Islander (0.6%) on an upperlevel staff of 165.  xThe Commission uses 1990 labor force statistics for license renewal applications filed after May 31, 1993, and for  yO- x1993 and subsequent Annual Employment Reports. See Public Notice #32651 (April 12, 1993). The 1990 Census  xdata for the TampaSt. PetersburgClearwater MSA shows a labor force that is 47.0% female and 16.5% minority  x(7.9% Black, 7.0% Hispanic, 1.2% Asian/Pacific Islander, and 0.4% American Indian). The station's 1993 Annual  xEmployment Report lists 80 females (41.2%), 19 Blacks (9.8%), seven Hispanics (3.6%), two Asian/Pacific Islanders  x(1.0%), and one American Indian (0.5%) on an overall staff of 194, including 56 females (33.9%), 14 Blacks (8.5%),  xYeight Hispanics (4.8%), two Asian/Pacific Islanders (1.2%), and one American Indian (0.6%) on an upperlevel staff  xzof 165. The station's 1994 report lists 79 females (38.5%), 17 Blacks, (8.3%), 11 Hispanics (5.4%), one  xJAsian/Pacific Islander (0.5%), and one American Indian (0.5%) among 205 employees overall, including 55 females  x-(31.4%), 14 Blacks (8.0%), nine Hispanics (5.1%), one Asian/Pacific Islander (0.6%), and one American Indian  x(0.6%) among 175 upperlevel employees. In the 1995 report, 80 females (39.6%), 16 Blacks (7.9%), 11 Hispanics  x(5.4%), one Asian/Pacific Islander (0.5%), and one American Indian (0.5%) are included among 202 employees  xoverall, and 58 females (33.5%), 12 Blacks (6.9%), nine Hispanics (5.2%), one Asian/Pacific Islander (0.6%), and"',l(l(l("  xyone American Indian (0.6%) are included among 173 upperlevel employees. " ,l(l(,,."Ԍ S- ` ԙx5. ` ` After reviewing the record before us, we conclude that there are no substantial and  xLmaterial questions of fact warranting designation for hearing and that grant of the renewal application for  xWFLATV would be consistent with Section 309(k) of the Communications Act of 1934, as amended,  Sg- x47 U.S.C  309(k). See Astroline Communications Co. Ltd. Partnership v. FCC, 857 F.2d 1556 (D.C.  S4- xCir. 1988). Further, we find no evidence that the licensee engaged in employment discrimination. The  xlicensee recruited and hired minorities throughout the license term. Accordingly, because the licensee is otherwise qualified, we will renew the license for WFLATV.  Sh- ` Qx6. ` ` However, we conclude that WFLATV's overall EEO efforts were deficient. Although  xthe licensee was able to show that it attracted only 83 minorities out of 984 applicants overall (8.4%) and  xonly 69 minorities out of 859 upperlevel applicants (8.0%), it appears that the licensee failed to self xassess its recruitment efforts. In this regard, we note that the licensee did not maintain the records needed  xfor meaningful selfassessment. The licensee could not identify the referral source for any of its  xapplicants. S - ` x7. ` ` We believe that the record in this case is similar to, but less egregious than, that of the  S - x.licensee of KSBWTV, Salinas, California, in KSBW License, Inc., 9 FCC Rcd 6701 (1994) ("KSBW").  S-  ?ԍ#C\  P6QgP#xThe Salinas, California MSA, where Station KSBWTV was located, had a labor force that was 36.8%  xminority (4.3% Black, 24.6% Hispanic, 7.0% Asian/Pacific Islander, and 0.9% American Indian) during the first four  xxyears of the station's license term, from 1989 to 1992. In 1993, the final year of KSBWTV's license term, the  xSalinas MSA had a labor force that was 44.9% minority (4.2% Black, 32.0% Hispanic, 8.0% Asian/Pacific Islander,  yO-and 0.7% American Indian).#&J\  P6Q/&P#Ѫ  Sj- xIn KSBW, the licensee contacted recruitment sources for 71 of 72 fulltime vacancies, but minorities were  xpresent in only 44 applicant (61.1%) and 41 interview (56.9%) pools. In addition, the licensee failed to  xcontact minority sources for 25 (34.7%) of its vacancies. The licensee also failed to maintain adequate  xrecords for selfassessment. The licensee provided applicant pool data for only 59 vacancies and interview  xpool data for only 56 vacancies. We renewed the license for KSBWTV subject to reporting conditions and issued a Notice of Apparent Liability for $15,000.  S- ` x8. ` ` The licensees of WFLATV and KSBWTV both filled a substantial number of vacancies  x(75 and 72, respectively) and attracted minorities to a similar percentage of applicant pools (62.1% and  xL61.1%, respectively). Both licensees also failed to maintain complete applicant and interview pool data,  xinformation which is essential for meaningful selfassessment. We note that WFLATV had a staff that  S9- xwas more than twice the size of KSBWTV's staff.59p  SI"-  ԍ#C\  P6QgP#xStation WFLATV had an average of 198 fulltime employees on its overall staff, while Station KSBWTV  yO!#-had an average fulltime staff of 88 employees. #&J\  P6Q/&P#5 However, on balance, we believe that the record of  x0WFLATV is less egregious because KSBWTV was located in an area with a significantly higher  xminority labor force (36.8% as compared to 16.5%) and because KSBWTV failed to contact minority x\specific recruitment sources for more than onethird of its vacancies. Given the facts of this case and  xbroadcasters' familiarity with our longstanding EEO Rule, we conclude that a $10,000 forfeiture is  xjustified. Further, we impose reporting conditions to monitor the station's prospective EEO performance.
