On July 1, 1996, the National Rainbow Coalition and Operation  xPUSH ("Rainbow") filed a petition to deny WIBC(AM)'s, WNAPFM's, and WENSFM's renewal  xkapplications. On September 11, 1996, Rainbow and the licensees filed a joint request for approval of  xzsettlement agreement, in which they requested that the Commission dismiss the petition to deny as it  xxpertains to WIBC(AM), WNAPFM, and WENSFM. By letter dated January 24, 1997, Commission staff  Sp- xyapproved the agreement and dismissed the petition to deny.qp:" yO -  "#X\  P6G;H;P#эxWe reviewed the settlement agreement pursuant to Prevention of Abuses of the Renewal Process, First  yO -Report and Order, 4 FCC Rcd 4780 (1989), as well as the Commission's Rules regarding settlement agreements. q As is our practice in all cases, however, we  SH - xreviewed the stations' EEO programs and performance pursuant to Section 309(d)(1) of the  S -Communications Act of 1934, as amended, 47 U.S.C.  309(d)(1). DISCUSSION  S -  S - ` x3. ` ` Section 73.2080 of the Commission's Rules requires that a broadcast licensee refrain from  xemployment discrimination and establish and maintain an EEO program reflecting positive and continuing  xefforts to recruit and promote qualified women and minorities. When evaluating EEO performance, the  x.Commission focuses on the licensee's efforts to recruit and promote qualified women and minorities and  xMthe licensee's ongoing assessment of its EEO efforts. Such an assessment enables the licensee to take  xcorrective action if qualified women and minorities are not present in the applicant and interview pools.  S- x{The Commission also focuses on any evidence of discrimination by the licensee. See 47 C.F.R.  73.2080(a), (b), and (c).  S@-    S- ` x4.` ` The licensee  acquired Station WIBC(AM) in June 1994. A review of Station  xWIBC(AM)'s 1996 EEO Program Report, inquiry response, and other pleadings reveal that the station had  x23 fulltime hiring opportunities, including 21 for upperlevel positions, from the time the licensee  S- xacquired WIBC(AM) to August 1, 1996.x :" yO`-  "#X\  P6G;H;P##X\  P6G;H;P#Ѝ#]\  PCH;P# xThe Indianapolis, Indiana Metropolitan Statistical Area ("MSA"), in which WIBC(AM) is located, had a  xlabor force that was 46.9% female and 13.3% minority (11.5% Black, 0.8% Hispanic, 0.8% Asian/Pacific Islander,  xand 0.2% American Indian) according to the 1990 Census. The 1995 Annual Employment Report for WIBC(AM)  xlists 16 women (32.0%) and three Blacks (6.0%) among 50 fulltime employees. Among 46 employees in upper xlevel jobs, the station had 13 women (28.3%) and two Blacks (4.4%). In 1996, the station had 50 employees,  xincluding 14 women (28.0%) and four Blacks (8.0%). It had 46 employees in upperlevel jobs, including 11 women (23.9%) and three Blacks (6.5%).  The licensee provided recruitment data only with respect to 12  xhiring opportunities (ten upperlevel). The licensee did not provide recruitment data with respect to 11  xhiring opportunities, which were filled during the period of August 1994 to August 1995, claiming that  x=records for these hires were "lost or destroyed." In its opposition, the licensee states that "[w]hen a job  xzopening occurs, the Stations contact more than thirty referral sources in an effort to produce qualified  xyfemale and minority applicants." According to the licensee, this statement is supported by a declaration,  xunder penalty of perjury, by Norman H. Gurwitz, Executive VicePresident and Corporate Counsel of  xEmmis Broadcasting Corporation and its subsidiary licensee corporations. The declaration does not  x explain how the records for 11 hires became "lost or destroyed." Because the licensee was unable to"`` ,1)1)ww"  x>document recruitment for the 11 hires and there is no basis for excusing this failure of documentation  S- xj[compare KTEHTV Foundation, 11 FCC Rcd 2994, 2996 (1996)], we are unable to credit its efforts for  S-those vacancies. See Act III Broadcasting of Nashville, Inc., 11 FCC Rcd 1172 (1995).  S`- ` x5.` ` Station WIBC(AM)'s recruitment efforts with respect to 12 positions included use of  xmultiple sources, including 26 minority sources, six minority/female sources, and one female source for  xjits openings. The licensee reports that the station received a total of 267 applicants, including 20 (7.5%)  xminorities, for 12 overall positions. With respect to ten upperlevel positions, the station received a total  xkof 138 applicants, including 15 (10.9%) minorities. The licensee interviewed a total of 94 applicants,  xincluding 16 (17.0%) minorities, for 12 overall positions. Of that total, 85 applicants, including 13  x(15.3%) minorities, were interviewed for ten upperlevel positions. Minorities were included in ten  xy(43.5%) of the station's 23 applicant pools for overall positions, and eight (38.1%) of 21 applicant pools  xfor upperlevel positions. Minorities were included in nine of the station's 23 interview pools (39.1%)  xyfor overall positions, and seven of 21 interview pools (33.3%) for upperlevel positions. In addition, the licensee points out that it hired three Blacks, two of whom were hired for upperlevel positions.  S - ` n  x6.` ` The 1996 EEO Program Reports for Stations WNAPFM and WENSFM, as well as their  xinquiry response and other pleadings, reveal that the licensees filled 24 fulltime vacancies, including 17  S0- xfor upperlevel positions, from August 1, 1993, to August 1, 1996.0: yO-#X\  P6G;H;P#э#X\  P6G;H;P#xThe licensee acquired WNAPFM in June 1994. It is operated jointly with WENSFM. The licensees state that they recruited  xfor all vacancies, using general and minorityoriented recruitment sources for all positions. In total, the  xlicensees used eight minority sources, 23 minority/female sources, and four female sources for their  x>openings. The licensees kept records on the referral source of 49 of their 53 minority applicants and  xjreport that at least 14 sources referred minority applicants. However, the licensees report that, although  xyrecruitment records were kept for all hiring opportunities, they lost records on applicants for three hiring  x-opportunities, one in January 1994 and two in August 1994. The licensees assert that records with respect  xto two hiring opportunities were lost during office moves and that the record for a third was lost after a  xformer supervisor left the company. The licensees provided complete records on the race and national  xorigin of applicants and interviewees for all 21 of their remaining hires. They report that 53 (7.1%)  x!minorities were among 747 total applicants and that 45 (11.5%) minorities were among 391 total  xinterviewees for 21 hiring opportunities. Minorities were included in at least 15 (62.5%) applicant pools,  xnine (52.9%) of which were for upperlevel positions. Minorities were included in at least 14 (58.3%)  xinterview pools, nine (52.9%) of which were for upperlevel positions. In addition, the licensees point  S-out that they hired six Blacks, two of whom were hired for upperlevel positions. ( X:" yO-  "#X\  P6G;H;P#Ѝ#]\  PCH;P# xThe Indianapolis, Indiana Metropolitan Statistical Area ("MSA"), in which WENSFM and WNAPFM are  xlocated, had a labor force that was 43.6% female and 13.5% minority (12.1% Black, 0.7% Hispanic, 0.5%  xAsian/Pacific Islander, and 0.2% American Indian) according to the 1980 Census. The 1990 Annual Employment  xReport for WENSFM lists 13 women (40.6%) and two Blacks (6.3%) among 32 fulltime employees. Among 29  x,employees in upperlevel jobs, the station had 10 women (34.5%) and two Blacks (6.9%). In 1991, the station had  x31 employees, including 15 women (48.4%) and three Blacks (9.7%). It had 18 employees in upperlevel jobs,  xincluding nine women (50.0%) and one Black (5.6%). In 1992, the station had 29 employees, including 14 women  x(48.3%) and three Blacks (10.4%). Among 26 employees in upperlevel jobs, there were 11 women (42.3%) and two Blacks (7.7%).   \xThe Commission uses 1990 Census data for all license renewal applications filed after May 31, 1993, and  yO'- xfor 1993 Annual Employment Reports and later reports. According to the 1990 Census, the Indianapolis MSA had a labor force"X(,1)1)("  xthat was 46.9% female and 13.3% minority (11.5% Black, 0.8% Hispanic, 0.8% Asian/Pacific Islander, and 0.2%  x,American Indian). In 1993, WENSFM had 28 employees, including 14 women (50.0%) and three Blacks (10.7%).  x,Among 25 upperlevel employees, the station employed 11 women (44.0%) and two Blacks (8.0%). As mentioned  yO- xin n.1, supra, the licensee acquired WNAPFM in June 1994, and operates it together with WENSFM. Conse xJquently, starting with their 1995 annual employment reports, the workforce data of WENSFM and WNAPFM are  xcombined. In 1995, the two stations had 49 employees, including 24 women (49.0%) and five Blacks (10.2%).  xwAmong 42 upperlevel employees, the stations employed 18 women (42.9%) and three Blacks (7.1%). In 1996, the  xxstations had 55 employees, including 26 women (47.3%) and five Blacks (9.1%). Included among 49 upperlevel employees were 20 women (40.8%) and three Blacks (6.1%). ",1)1)ww/"Ԍ S- ` ԙx7. ` ` The licensees of all three stations maintain that they "made diligent efforts in good faith  xto attract minority employees" during the license term. The licensees also argue that they have taken steps  xto improve their record-keeping procedures in order to better document recruitment efforts. They state  x=that these steps include ensuring that all personnel involved in implementing the EEO program "undergo  xappropriate training." They contend that their EEO efforts warrant unconditional renewal of the stations' licenses.  S- ` 3x8.` ` Our review of the record reveals that there are no substantial and material questions of  S- xfact warranting designation of this case for hearing. See Astroline Communications Co. v. FCC, 857 F.2d  S- x01556 (D.C. Cir. 1988). Moreover, there is no evidence that the licensees engaged in employment  xdiscrimination. The stations recruited, attracted, hired, and employed minorities and women during the  x=license term. Therefore, finding the licensees to be otherwise qualified, grant of the renewal applications  xfor Stations WIBC(AM), WNAPFM, and WENSFM would be consistent with Section 309(k) of the Communications Act of 1934, as amended, 47 U.S.C.  309(k).  S - ` x9.` ` Nevertheless, we find Station WIBC(AM)'s recruitment efforts to be deficient. The station  xfailed to document recruitment for 11 (47.8%) of 23 hiring opportunities during the review period. In  x.addition, minorities were shown to be present in fewer than half of its applicant and interview pools for  xoverall and upperlevel positions. Further, we find that the station failed to maintain adequate records for meaningful selfassessment. 47 C.F.R.  73.2080.  S- ` Bx 10.` ` We believe that the record of Station WIBC(AM) is similar to, but less egregious than,  S- xythat of Stations WDOD(AM)/WDODFM, Chattanooga, Tennessee, in In re Applications of WDOD of  Sh- x<Chattanooga, Inc. for Renewal of Licenses of Stations WDOD(AM)/WDODFM, Chattanooga, Tennessee,  S@- xK12 FCC Rcd 6399 (1997) ("WDOD of Chattanooga, Inc."). Stations WDOD(AM)/WDODFM are located  xin a labor force that is 13.4% minority. The stations recruited for 14 of 21 hires (66.7%). In that case,  xbecause the stations could document recruitment for only 66.7% of their vacancies, included minorities  x.in only four (19.1%) of the station's 21 applicant pools and three (14.3%) interview pools, and failed to  xmaintain adequate records for meaningful selfassessment, we renewed the stations' licenses subject to reporting conditions and a Notice of Apparent Liability for Forfeiture in the amount of $11,000.  S(- ` _x 11.` ` Stations WIBC(AM) and WDOD(AM)/WDODFM are located in areas with equivalent xsized minority labor forces (13.3% and 13.4%, respectively). Both licensees had similar numbers of hires  x[23 for WIBC(AM) and 21 for WDOD(AM)/WDODFM]. Both licensees argued that they routinely  xkrecruited for their openings, but neither could document recruitment for all of their vacancies. Station  xnWIBC(AM) documented recruitment for only 12 (52.2%) of its 23 vacancies; and Stations  xWDOD(AM)/WDODFM documented recruitment for only 14 (66.7%) of their 21 vacancies. In both  xcases, this recordkeeping failure hampered the stations' ability to engage in meaningful selfassessment"8,1)1)ww "  xfor a sustained period of time. However, because WIBC(AM) had a higher percentage of applicant and  xinterview pools that included minorities [43.5% and 39.1%, respectively, for WIBC(AM); and 19.1% and  xL14.3%, respectively, for WDOD(AM)/WDODFM], we find that WIBC(AM)'s record is less egregious  xthan that of WDOD(AM)/WDODFM. On balance, we find that the circumstances here justify issuance  xof a Notice of Apparent Liability for Forfeiture for $10,000. Also, we impose reporting conditions on WIBC(AM) in order to monitor the station's recordkeeping and selfassessment efforts.  S- IV. CONCLUSION ă  S- ` Px 12.` ` After reviewing the record before us, we find that a hearing is not warranted and that grant  x-of the renewal applications for Stations WIBC(AM), WNAPFM, and WENSFM is in the public interest.  xWe grant the renewal applications for Stations WNAPFM and WENSFM without conditions. Because  xthe overall EEO efforts of the licensee of Station WIBC(AM) were deficient, we will grant the renewal  xapplication for this station subject to a Notice of Apparent Liability for $10,000. We also impose  xjreporting conditions on WIBC(AM) in order to monitor the station's recordkeeping and selfassessment efforts.  SX- V.
