The 1990   Annual Employment Report of Stations WVAX(AM)/WDBR(FM) lists 12 females (40.0%) and no minorities on   an overall staff of 30, and 11 females (37.9%) on an upperlevel staff of 29. In 1991, the stations employed 13   jfemales (40.6%) and two Blacks (6.3%) on an overall staff of 32 and 10 females (34.5%) and two Blacks (6.9%)   on an upperlevel staff of 29. In 1992, the stations employed 12 females (37.5%) and one Black (3.1%) on an overall staff of 32 and 11 females (35.5%) and one Black (3.2%) on an upperlevel staff of 31.   The Commission uses 1990 labor force statistics for license renewal applications filed after May 31, 1993, and for  xP-  1993 Annual Employment Reports. See Public Notice # 32651 (April 12, 1993). According to 1990 Census data,   Lthe Springfield, Illinois MSA includes 49.1% females and 7.4% minorities (6.0% Black and 1.4% Other). The   >stations' 1993 Report lists 14 females (42.4%) and one Black (3.0%) on an overall staff of 33 and 13 females   =(40.6%) and one Black (3.1%) on an upperlevel staff of 32. The stations' 1994 Report lists 10 females (35.7%)   jand no minorities on an overall staff of 28 and nine females (34.6%) on an upperlevel staff of 26. The licensee   took control of Stations WVAX(AM)/WYXY(FM) on November 15, 1994. The 1995 Report for Stations   WTAX(AM)/WDBR(FM) and WVAX(AM)/WYXY(FM) lists 18 females (41.9%) and no minorities on an overall   staff of 43 and 15 females (37.5%) on an upperlevel staff of 40. The stations' 1996 Report reflects 15 females (34.9%) and no minorities on an overall staff of 43 and 13 females (31.7%) on an upperlevel staff of 41. In its opposition, the licensee acknowledges that it did not contact outside sources for five",@(@(hhV"  X-  positions ܕ yOy-#X\  P6G; ɓP#эFor one of these positions, the licensee indicates that it was seeking to employ a particular onair personality. For another of these vacancies, the licensee states that the hiree was recruited the day after the employee who formerly held the position resigned. For two additional positions, the licensee states that it created positions for two individuals who applied to the stations unsolicited.  and did not have a record of its recruitment contacts for two additional positions. For one   vacancy, it contacted three general sources and, for the remaining 36 vacancies, it contacted two   to three minority sources and four to 13 general sources. In addition, it contacted a women's   =source for 19 vacancies. In a sworn declaration attached to the opposition, the former General   =Manager of the stationswho left his position as General Manager on July 1, 1996, to work for   the proposed assignee of the stationsstates that, approximately two years before the end of the   Llicense term, he added a minority weekly newspaper, as well as additional general newspapers,   >to the recruitment list. These sources referred several minority applicants. However, these   sources were not consistently contacted for all subsequent vacancies. In addition, the licensee  X -  indicates that it did not know the race or national origin of 227 (56.9%) of its 399 applicants. ܕ yO{-#X\  P6G; ɓP#эThe licensee did not have any applicant information for two vacancies.   The data in its opposition show that at least six (1.5%) of the 399 applicants were minorities.   The licensee indicates that minorities were present in nine overall (20.4%) and seven upperlevel   (17.9%) applicant and interview pools. The licensee reports that it hired one Black applicant for   a lowerlevel position and offered an upperlevel position to another Black applicant, who declined.  Xy-  #5.` ` After considering the record before us, we conclude that there are no substantial   Mand material questions of fact warranting a hearing. The licensee recruited and interviewed   minorities and hired a minority during the review period. Hence, there is no evidence that the   licensee engaged in employment discrimination. Therefore, finding the licensee to be otherwise qualified, renewal of the licenses is appropriate.  X-  6.` ` We find, however, that the licensee's overall EEO efforts with respect to minorities   [were deficient. Despite the presence of minorities in the stations' available labor force (6.0% in   {1980 and 7.4% in 1990), as well as the significant number of hiring opportunities, only six   (1.5%) of 339 applicants for 44 vacancies were minorities and minorities were present in only   nine (20.4%) applicant pools. Although the licensee added sources to its recruitment list, these   new sources were not consistently contacted for every vacancy. The licensee also failed to   lmaintain information regarding the race or national origin of 56.9% of its applicants, data necessary for thorough and meaningful selfassessment of a station's EEO program.  X7-  X -  7.` ` After carefully reviewing the facts, we find that the record in the instant case is  X -  similar to that of KDYL(AM)/KSFIFM, Salt Lake City, Utah, in Application of Holiday" @,@(@(hh="  X-  Broadcasting, 10 FCC Rcd 4500 (1995) (Holiday).ܕ yOy-#X\  P6G; ɓP#эKDYL(AM)/KSFIFM were located in the Salt Lake CityOgden, Utah MSA. The labor force was 7.5% minority (0.8% Black, 4.5% Hispanic, and 2.2% Other). In Holiday, the Commission found that the   licensee, who contacted a variety of sources for 14 of 16 vacancies, failed to adequately self  assess its EEO program as it engaged in inconsistent recruitment efforts and recruited only one   minority (1.1%) in only one applicant pool out of 91 applicants/interviewees for 16 positions.   Accordingly, we renewed the licenses of KDYL(AM)/KSFIFM subject to reporting conditions and issued a Notice of Apparent Liability for $8,000.  X_-  8.` ` In the instant case, the licensee engaged in inconsistent recruitment efforts,   >attracted only six minority applicants (1.5%) out of a total of 399 for only nine (20.4%) of 44   ]applicant pools, and failed to maintain complete applicant information for over half of its   applicants, information necessary for meaningful selfassessment. Therefore, the licensees of   =KDYL(AM)/KSFIFM and WTAX(AM)/WDBR(FM)/WVAX(AM)/WYXY(FM) both failed to   consistently recruit for minorities and adequately selfassess their EEO programs despite being   located in areas with significant minority labor forces (7.5% and 6.0%/7.4%, respectively) and   [attracting few minority applicants (1.1% and 1.5% of all applicants, respectively). The stations   0in this case had more hiring opportunities than KDYL(AM)/KSFIFM but they also had   =minorities in a larger number of applicant pools. Given the facts of this case and broadcasters'   jfamiliarity with our longstanding EEO rule, we conclude that a Notice of Apparent Liability for   !$8,000 is appropriate. Further, we impose reporting conditions to monitor the licensee's   prospective recruitment and recordkeeping measures. Accordingly, finding the licensee to be   otherwise qualified, we will grant renewal subject to reporting conditions, and issue a Notice of  X-Apparent Liability for $8,000.x ܕ yO-#X\  P6G; ɓP#эOn July 10, 1996, the applications to assign the licenses of Stations WTAX(AM)/WDBR(FM) and WVAX(AM)/WYXY(FM) to Saga Communications of Illinois, Inc. were granted by the Commission. Consummation of the assignment has been postponed by the parties pending a decision by the Commission concerning the stations' renewal applications.
